SENATE BILL NO. 14

LOCAL AGENCIES.  Provides for peace officers employed by the Housing Authority of
New Orleans. (gov sig)
AN ACT1
To enact R.S. 40:456.1, relative to the Housing Authority of New Orleans; to provide for the2
appointment, compensation, duties, and powers of its peace officers; and to provide3
for related matters.4
Notice of intention to introduce this Act has been published.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 40:456.1 is hereby enacted to read as follows: 7
ยง456.1 The Housing Authority of New Orleans; peace officers; appointment,8
compensation, duties, and powers9
A. The Housing Authority of New Orleans, referred to hereafter as10
HANO, may appoint and commission peace officers who shall enforce laws,11
rules, and regulations to secure the protection of persons, properties, or12
interests relating to HANO.13
B. HANO's peace officers may carry weapons, concealed or exposed14
while in the performance of their duties, and shall take such action as is15
authorized by law, rule, or regulation to protect persons, properties, or interests16
relating to HANO.  Such peace officers shall exercise regular police powers of17 SB NO. 14

the state granted to law enforcement officers with respect to issuing civil1
citations for littering and with respect to criminal and other offenses affecting2
the protection of persons, properties, or interests relating to HANO or affecting3
the performance of their duties.4
C. HANO's peace officers shall be P.O.S.T. certified in accordance to the5
Peace Officers Standard and Training Law.  Certified peace officers shall be6
eligible to receive supplemental pay after successfully completing a council-7
approved training program and passing the council-approved examination.8
D.  HANO's peace officers shall prevent and detect crime, apprehend9
criminals, enforce the criminal and traffic laws of the state, keep the peace and10
good order in the state by the enforcement of the state's police powers, and11
perform any other related duties imposed upon them by the legislature.12
Section 2. This Act shall become effective upon signature by the governor or, if not13
signed by the governor, upon expiration of the time for bills to become law without signature14
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If15
vetoed by the governor and subsequently approved by the legislature, this Act shall become16
effective on the day following such approval.17

Proposed law provides that the Housing Authority of New Orleans (HANO) may appoint
and commission peace officers to enforce laws, rules, and regulations to protect persons,
properties or interests relating to HANO.
Proposed law provides HANO's peace officers with the following powers:
a. May carry weapons, concealed or exposed while in the performance of their duties.
b. Shall take such action as is authorized by law, rule, or regulation to protect persons,
properties, or interests relating to HANO.
c. Shall exercise regular police powers of the state granted to law enforcement officers
with respect to issuing civil citations for littering and with respect to criminal and
other offenses.
Proposed law requires HANO's peace officers to be P.O.S.T. certified.  Provides that
certified peace officers shall be eligible to receive supplemental pay after successfully
completing a council-approved training program and passing the council-approved

Proposed law provides that the duties of HANO's peace officers are to:
a. Prevent and detect crime.
b. Apprehend criminals and enforce the criminal and traffic laws of the state.
c. Keep the peace and good order in the state by the enforcement of the state's police
powers.
d. Perform any other related duties imposed upon them by the legislature.
Effective upon signature of the governor or lapse of time for gubernatorial action.
