AN ACT1
To enact R.S. 37:1291.1, relative to out-of-state physician orders; to provide for an out-of-2
state physician to order diagnostic tests under certain conditions; to provide for3
definitions; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 37:1291.1 is hereby enacted to read as follows: 6
ยง1291.1.  Out-of-state physician orders7
A. The board may adopt rules, in accordance with the Administrative8
Procedure Act, exempting application of this Part to an out-of-state physician9
who orders routine diagnostic testing for an established patient, provided the10
physician-patient relationship was initiated through an in-person, face-to -face11
visit with the physician in another state, the order can be verified, and the12
results of all testing are provided directly to the ordering out-of-state physician.13
A health care facility or provider that is presented such an order may choose14
not to recognize such an order.15
B. For the purposes of this Section, "out-of-state physician" means a16
physician who is duly licensed to practice medicine in any state or jurisdiction17
in the United States other than Louisiana.18
