PHARMACISTS.  Allows a pharmacist to administer certain immunizations.
AN ACT1
To amend and reenact R.S. 37:1218, relative to the administration of certain immunizations;2
to provide for a pharmacist to administer certain immunizations; to provide for an3
effective date; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 37:1218 is hereby amended and reenacted to read as follows: 6
ยง1218.  Administration of influenza immunization certain immunizations7
A. A pharmacist may administer an influenza immunization certain8
immunizations, as provided for in Subsection B of this Section, to any person9
seven years of age or older without a prescription or medical order contingent upon10
all of the following provisions:11
(1) The pharmacist shall administer influenza immunizations each12
immunization in conformance with the most current annual influenza vaccination13
administration protocol as set forth by the United States Centers for Disease Control14
and Prevention (CDC) Public Health Service Advisory Committee on15
Immunization Practice Practices (ACIP), following guidance published in the16
Louisiana State Immunization Policies and Procedures Manual, to participate17 SB NO. 60

in the program, and to be covered by the National Vaccine Injury1
Compensation Program.2
(2) The pharmacist shall report each influenza immunization to the Louisiana3
Office of Public Health Health's Louisiana Immunization Registry Network for4
Kids Statewide (LINKS) at the time of the immunization or as soon as reasonably5
practicable thereafter, as this is the official state vaccination record.6
(3) The pharmacist shall report all adverse events he observes or which are7
reported to him to the Vaccine Adverse Events Reporting System (VAERS), the8
cooperative program of the United States Centers for Disease Control and9
Prevention (CDC) and the United States Food and Drug Administration for vaccine10
safety, or its successor program; and further, the pharmacist shall refer the patient11
with an adverse event to the influenza an immunization for appropriate medical care.12
(4) The pharmacist shall maintain for at least two years a record of each13
influenza immunization administered.14
(5) The pharmacist shall obtain the appropriate credential to administer15
influenza immunizations from the board, as administratively defined, prior to16
administering any such immunization.17
B. A pharmacist may administer any of the following vaccines, but only18
in conformance with the provisions of Subsection A of this Section:19
(1) Influenza, to any person seven years of age or older.20
(2) Pneumococcal, to any person eighteen years of age or older.21
(3) Zoster, to any person eighteen years of age or older.22
(4) Tetanus and Diphtheria Toxoids Adsorbed for Adult Use (Td), to any23
person eighteen years of age or older.24
(5) Tetanus Toxoid, Reduced Diphtheria Toxoid and Acellular Pertussis25
Vaccine Adsorbed (Tdap), to any person eighteen years of age or older.26
Section 2. The provisions of this Act shall only become effective upon the final27
adoption of rules and regulations duly promulgated in accordance with the Administrative28
Procedure Act by the Louisiana Board of Pharmacy pursuant to the provisions of this Act.29 SB NO. 60

Present law allows a pharmacist to administer the influenza vaccination to any person seven
years of age or older.
Proposed law retains present law but expands the types of vaccinations which can be
administered by a pharmacist to persons 18 years of age or older to include the following:
(1) Pneumococcal
(2) Zoster
(3)Tetanus and Diphtheria Toxoids Adsorbed for Adult Use (Td)
(4)Tetanus Toxoid, Reduced Diphtheria Toxoid and Acellular Pertussis Vaccine
Adsorbed (Tdap)
Effective upon final adoption of certain rules and regulations promulgated in accordance
with the APA by the La. Board of Pharmacy pursuant to the 	proposed law.

Summary of Amendments Adopted by Senate
Committee Amendments Proposed by Senate Committee on Health and Welfare to
the original bill.
1. Adds provision which requires the administration of immunizations by a
pharmacist to be in conformance with guidance published in the Louisiana
State Immunization Manual.
2. Changes the age at which the pharmacist may administer a vaccine for
Pneumococcal, Zoster, Tetanus and Diphtheria Toxoids Adsorbed for Adult
Use (Td), and Tetanus Toxoid, Reduced Diphtheria Toxoid and Acellular
Pertussis Vaccine Adsorbed (Tdap) to a person without prescription or
medical order from 7 to 18 years of age.
3. Technical amendments
Senate Floor Amendments to engrossed bill.
1. Provides for an effective date upon final adoption of rules and regulations
promulgated by the La. Board of Pharmacy.
2. Corrects the name of the La. State Immunization Policies and Procedures
Manual.
3. Corrects the name of the National Vaccine Injury Compensation Program.
