SENATE RESOLUTION NO. 15
BY SENATOR MORRELL 
ENVIRONMENT QUALITY DEPT. Directs DEQ to conduct soil sampling on certain
dredged material.
A RESOLUTION1
To direct the secretary of the Department of Environmental Quality to conduct soil sampling2
on material dredged along the right descending bank of the Mississippi River Gulf3
Outlet at the confluence of the Inner Harbor Navigation Canal in Orleans Parish with4
the permit applicant paying the cost of such sample.5
WHEREAS, in 2008, the United States Army Corps of Engineers requested a water6
quality certification to widen and improve the Inner Harbor Navigation Canal; and7
WHEREAS, there were one hundred thirteen constituents of concern sampled at8
twenty-four sampling sites; and9
WHEREAS, the Department of Environmental Quality determined the samples had10
values within non-industrial standards; and 11
WHEREAS, the Department of Environmental Quality did not receive any public12
comments and issued the water quality certification in May of 2009; and13
WHEREAS, in February of 2011, Southern Recycling requested a water quality14
certification to dredge for installation of a dock for barge access near their Florida Avenue15
site; and16
WHEREAS, there is concern about possible contaminants in the dredged material17
due to one hundred thirteen constituents of concern found in the 2008 sampling; and18 SR NO. 15

WHEREAS, R.S. 30:2011(D)(2) authorizes the secretary of the Department of1
Environmental Quality to require such conditions in individual instances as are necessary2
to assure compliance with applicable laws and regulations.3
THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana4
does hereby direct the secretary of the Department of Environmental Quality to conduct soil5
sampling along the right descending bank of the Mississippi River Gulf Outlet at the6
confluence of the Inner Harbor Navigation Canal in Orleans Parish with the permit applicant7
paying the cost of such sample.8
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to9
Southern Recycling and to the secretary of the Department of Environmental Quality.10
