TEACHERS/EVALUATION:  Requires approval by the House and Senate education
committees of the value-added teacher assessment model prior to implementation of
certain evaluation program requirements
AN ACT1
To amend and reenact R.S. 17:3883(A)(8) and 3902(B)(5), relative to teacher evaluations;2
to change the implementation date for certain requirements of the teacher evaluation3
program; to require approval by the House and Senate education committees of the4
value-added assessment model prior to such implementation; to change the initial5
reporting date for certain annual reports submitted by the State Board of Elementary6
and Secondary Education relative to the assessment model; and to provide for related7
matters.8
Be it enacted by the Legislature of Louisiana:9
Section 1. R.S. 17:3883(A)(8) and 3902(B)(5) are hereby amended and reenacted10
to read as follows: 11
§3883.  State Board of Elementary and Secondary Education; powers and duties12
A.  The board shall:13

committees, regarding the implementation, results, and effectiveness of the value-1
added assessment model as provided in this Part.2

§3902.  Evaluation program; process; approval4

B. The elements of evaluation and standards for effectiveness shall be6
defined by the board pursuant to rules and regulations promulgated for such purpose.7
Such rules and regulations shall require that, at a minimum, local evaluation plans8
contain the following elements:9

(5) Measure of effectiveness.  By the beginning of the 2012-2013 For the11
2013-2014 school year and thereafter, fifty percent of such evaluations shall be based12
on evidence of growth in student achievement using a value-added assessment model13
as determined by the board for grade levels and subjects for which value-added data14
is available provided that the model that is being used has been approved by the15
House Committee on Education and the Senate Committee on Education, meeting16
separately or jointly. For grade levels and subjects for which value-added data is not17
available and for personnel for whom value-added data is not available, the board18
shall establish measures of student growth. The model shall take into account19
important student factors, including but not limited to special education, eligibility20
for free or reduced price meals, student attendance, and student discipline. The state21
board shall develop and adopt a policy to invalidate such student growth data for any22
teacher for any school year in which there is a natural disaster or any other23
unexpected event that results in the temporary closure of the school.24

Abstract: Delays implementation of certain requirements of the teacher evaluation program
until the 2013-2014 school year and provides that such implementation is contingent
upon the approval by the House and Senate education committees of the value-added
assessment model to be used in the evaluations. 
Present law requires annual evaluations by local public school boards for all teachers and
administrators in accordance with State Board of Elementary and Secondary Education
(BESE) rules and regulations. Provides that the elements of evaluation and standards for
effectiveness shall be defined by BESE and further provides that by the 2012-2013 school
year, 50% of each evaluation shall be based on evidence of growth in student achievement
using a value-added assessment model as determined by BESE. Requires BESE to submit
a written report to the House and Senate education committees prior to the 2011 and 2012
regular sessions on the development of the value-added assessment model. Authorizes the
committees to meet separately or jointly and provides that the committees may disapprove
the assessment model upon the majority vote of each committee if they determine that the
methodology is arbitrary or not evidence-based. Requires BESE, beginning in 2013,
annually to submit a written report to the House and Senate education committees regarding
the implementation, results, and effectiveness of the value-added assessment model.
Proposed law retains present law except provides for implementation of the 50%
requirement for the 2013-2014 school year and thereafter instead of by the 2012-2013 school
year and provides that implementation shall occur only if the assessment model is approved
by the House and Senate education committees. Changes the initial annual reporting date for
BESE from 2013 to 2014 based upon such implementation.
