SUITS AGAINST STATE: Provides relative to suits against the state and political
subdivisions
AN ACT1
To amend and reenact R.S. 13:5101(B), relative to suits against the state and political2
subdivisions; to provide for applicability; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1.  R.S. 13:5101(B) is hereby amended and reenacted to read as follows: 5

B. This Part applies to any suit in contract or for injury to person or property	,8
or for penalties against the state, a state agency, an officer or employee of the state9
or a state agency arising out of the discharge of his official duties or within the10
course and scope of his employment, or a political subdivision of the state, as defined11
herein, or against an officer or employee of a political subdivision arising out of the12
discharge of his official duties or within the course and scope of his employment.13
The provisions of this Part shall not supersede the provisions of R.S. 15:1171 et seq.14

Abstract: Provides that the La. Governmental Claims Act applies to suits for penalties.
Present law provides that the La. Governmental Claims Act applies to any suit in contract
or for injury to person or property against the state, a state agency, a political subdivision,
or an officer or employee of the state, state agency, or political subdivision, arising out of
the discharge of his official duties or within the course and scope of his employment.  
Proposed law retains present law and includes application to suits for penalties.
