GERMAIN AN ACT1 To amend and reenact R.S. 30:2418(H)(1) and (I)(2), relative to recycling waste tires; to2 provide for payment to waste tire processors; to provide for insurance and financial3 responsibility requirements; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 30:2418(H)(1) and (I)(2) are hereby amended and reenacted to read6 as follows:7 ยง2418. Waste tires8 * * *9 H. The secretary shall promulgate rules, regulations, and guidelines for the10 administration and enforcement of the waste tire program provided for in this11 Chapter, which shall be subject to legislative review and approval by the Senate12 Committee on Environmental Quality and the House Committee on Natural13 Resources and Environment. The rules, regulations, and guidelines shall provide for14 but not be limited to:15 (1) Establishing standards, requirements, and permitting procedures for16 waste tire transporters, collection sites, and processors. Requirements shall include17 proof of commercial liability insurance in a sufficient amount and other evidence of18 financial responsibility as determined by the secretary. (2) A permitted waste tire processing facility shall be paid a minimum of one1 dollar and fifty seven and a half cents per twenty pounds pound of waste tire material2 that is recycled or that reaches end-market uses or per twenty pounds pound of whole3 waste tires marketed and shipped to a qualified recycler .
