AN ACT1
To enact R.S. 17:87.6(C), relative to alienation of school property by school boards; to2
authorize local public school boards to sell certain used individual computing3
devices at private sale to students or their parents, tutors, or legal guardians; to4
provide limitations on such sales and for the deposit and use of funds derived from5
such sales; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 17:87.6(C) is hereby enacted to read as follows:8

C.(1) Any local public school board may sell as provided in this Subsection,11
individual computing devices that have been used by students for classwork,12
notwithstanding any provision of law to the contrary.13
(2) When the school board determines that an individual computing device14
used by a student or students has reached the end of its typical life cycle, is no longer15
needed for school purposes, and will be removed from classroom use, and that the16
best interest of the public school system would be served by the private sale of such17
device due to the cost of auctioning the device or recycling it or due to other factors,18
the school board may sell the device to a student enrolled in a school in the school19
system or to the parent, tutor, or legal guardian of such a student.20 ENROLLEDHB NO. 1109

(3) The sale price for the device shall be reasonably equivalent to the value1
of the device, taking into consideration its typical life cycle, current condition, and2
costs of other methods of alienation or disposal.3
(4) All such sales shall be in accordance with school board policies, and sale4
prices shall be approved by appropriate school system administrative personnel prior5
to sale. Proceeds from such sales shall be deposited by the school board and shall6
be used for general fund expenditures of the school board.7
(5) This Subsection shall apply only to individual computing devices used8
for classwork by students and shall not apply to other computer equipment or related9
equipment such as routers, switches, or servers.10
Section 2. This Act shall become effective upon signature by the governor or, if not11
signed by the governor, upon expiration of the time for bills to become law without signature12
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If13
vetoed by the governor and subsequently approved by the legislature, this Act shall become14
effective on the day following such approval.15
