Regular Session, 2012 HOUSE BILL NO. 1115 BY REPRESENTATIVE BADON SCHOOLS: Prohibits alternative programs and alternative schools from being operated at schools providing services to students other than those in the alternative program or school AN ACT1 To amend and reenact R.S. 17:416.2(C) and to enact R.S. 17:100.5(E), relative to alternative2 schools and programs; to provide relative to the location of such schools and3 programs; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 17:416.2(C) is hereby amended and reenacted and R.S. 17:100.5(E)6 is hereby enacted to read as follows: 7 §100.5. Alternative schools; establishment by local boards 8 . * * *9 E. Alternative education programs or schools shall not be operated at schools10 that enroll students other than those in the alternative program or school.11 * * *12 §416.2. Present law provides for the establishment and maintenance of alternative schools by parish and city school boards, with the approval of the State Board of Elementary and Secondary Education (BESE). Provides that BESE shall develop, adopt, and implement appropriate guidelines for alternative schools. Requires that students eligible for enrollment in alternative schools shall be determined from a list of disruptive students compiled by each city and parish school board. Provides that each city or parish school board operating an alternative school annually shall evaluate such school. Proposed law retains present law. Present law defines alternative education programs as programs designed to increase the likelihood that students who are unmotivated or unsuccessful in traditional programs or who are disruptive in the traditional school environment remain in school and obtain a high school diploma. Such programs may include programs that hold students to strict standards of behavior in highly structured and controlled environments, sometimes referred to as "boot camps", "police schools", or "court schools". Proposed law retains present law. Proposed law adds provision that prohibits alternative education programs or schools from being operated at schools that enroll students other than those in the alternative program or school.
