LABOR:  Provides for secret ballot elections for labor organization membership
AN ACT1
To enact R.S. 23:825, relative to labor organizations; to provide for the method of acquiring2
the representation of a labor organization; to prohibit card check; to provide for3
definitions; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 23:825 is hereby enacted to read as follows:6
ยง825. Vote on representation by labor organization; card check prohibited7
Any vote cast to elect to be represented by a labor organization shall be by8
secret ballot. The use of card check to cast a vote to join or to certify a labor9
organization as the bargaining agent for employees is prohibited. For purposes of this10
Section, "card check" is any unsealed card, public ballot, or other non-secret manner11
of expressing an employee's choice as to labor organization representation.12

Proposed law defines "card check" as any unsealed card, public ballot, or other non-secret
manner of expressing an employee's choice regarding labor organization representation.
