Regular Session, 2012 HOUSE BILL NO. 199 BY REPRESENTATIVE GIROD JACKSON PROCUREMENT: Provides for minimum goals for the La. Initiative for Small Entrepreneurships (the Hudson Initiative) and the Veteran Initiative AN ACT1 To amend and reenact R.S. 39:2004 and 2174, relative to procurement and public contracts;2 to provide for minimum goals for small entrepreneurship participation in state3 procurement and public contracts; to provide minimum goals for veteran and service-4 connected disabled veteran-owned small entrepreneurship participation in state5 procurement and public contracts; to provide for an effective date; and to provide for6 related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 39:2004 and 2174 are hereby amended and reenacted to read as9 follows: 10 §2004. State goals for procurements and public contracts11 The commissioner of administration shall establish annual goals for small12 entrepreneurship participation in state procurements and public contracts. The13 commissioner shall determine the appropriate level and number of goals for each14 year. The formulation of each goal shall be based on historical procurement and15 public contracting data and any other factors which the commissioner deems useful.16 As part of development of goals, the commissioner may consider the capacity of17 small entrepreneurships available to participate in meeting goals, which may be18 determined based on past experience, available small entrepreneurship certifications,19 and recognized industry composition. The1 commissioner shall provide guidance to agencies with respect to estimation of dollar2 values for anticipated procurement and contract activity to be used in the3 development of a goal. Agencies shall report any data required by the commissioner4 in this regard in accordance with a schedule established by the commissioner.5 * * *6 §2174. Provides that the commissioner of administration shall establish annual goals for veteran and service- connected disabled veteran-owned small entrepreneurship participation in state procurements and public contracts.
