AN ACT1
To amend and reenact R.S. 33:9097.8(B), (E)(8), (F)(1)(b), and (G)(1), relative to the2
Broadmoor Crime Prevention and Improvement District in East Baton Rouge Parish;3
to modify the boundaries of the district; to provide with respect to the parcel fee that4
the parish is authorized to impose on behalf of the district; and to provide for related5
matters.6
Notice of intention to introduce this Act has been published7
as provided by Article III, Section 13 of the Constitution of8
Louisiana.9
Be it enacted by the Legislature of Louisiana:10
Section 1. R.S. 33:9097.8(B), (E)(8), (F)(1)(b), and (G)(1) are hereby amended and11
reenacted to read as follows:12
ยง9097.8.  Broadmoor Crime Prevention and Improvement District13

B. Boundaries.  The boundaries of the district shall be coterminous with the15
boundaries of the Broadmoor Subdivision in East Baton Rouge Parish as established16
in the official subdivision plat filed with the clerk of court of East Baton Rouge17
Parish. The boundaries of the district shall include all the property within, and no18
property outside of, the following subdivisions in East Baton Rouge Parish as19
established by the official subdivision plats thereof filed with the clerk of court of20
East Baton Rouge Parish: Broadmoor, East Broadmoor, North Broadmoor Circle,21
Broadmoor Oaks, Broadmoor Place, Broadmoor Terrace, Oak Hill, South22
Broadmoor, Clarice Browning Arnold Tract, and Broadmoor Estates.  In addition,23 ENROLLEDHB NO. 252

the district shall include lots B-4-1, B-4-2, and B-4-3 and Lot M of the Edmund R.1
Sharp Property as shown by the official records of the  clerk of court of East Baton2
Rouge Parish.3

E. Powers and duties.  The district, acting through its board of5
commissioners, shall have the following powers and duties:6

(8) To perform or have performed any other function or activity necessary8
for the achievement of the purpose purposes of the district.9
F. Parcel fee.  The governing authority of East Baton Rouge Parish is hereby10
authorized to impose and collect a parcel fee within the district subject to and in11
accordance with the provisions of this Subsection:12
(1)(a) The fee shall be imposed on each improved and unimproved parcel13
located within the district.14
(b) For the purposes of this Section, a parcel shall be defined as a lot, a15
subdivided portion of ground, or an individual tract on which a residential or16
commercial structure is situated; however, the term "parcel" shall not include17
"condominium parcel" or "condominium property" as defined in R.S. 9:1121.103.18

G. Budget.  (1)  The board of commissioners shall adopt an annual budget20
in accordance with the Louisiana Local Government Budget Act, R.S. 39:1301 et21
seq.  The budget and all amendments shall be submitted to the East Baton Rouge22
Metropolitan Council.23

Section 2. This Act shall become effective upon signature by the governor or, if not25
signed by the governor, upon expiration of the time for bills to become law without signature26 ENROLLEDHB NO. 252

by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If1
vetoed by the governor and subsequently approved by the legislature, this Act shall become2
effective on the day following such approval.3
