HOUSE BILL NO. 288
BY REPRESENTATIVE LAMBERT
APPROPRIATIONS/JUDGMENT:  Appropriates funds for payment of judgments in the
matter of "Gretchen Darone, et al v. DOTD" consolidated with "Joseph Bayhi, Sr.,
et al v. DOTD" consolidated with "Bo McAllister, et al v. DOTD"
AN ACT1
To appropriate funds out of the General Fund of the state of Louisiana for Fiscal Year 2012-2
2013 to be used to pay the consent judgments in the suit entitled "Gretchen Darone,3
et al v. State of Louisiana, through the Department of Transportation and4
Development, et al" consolidated with "Joseph Bayhi, Sr., et al v. State of Louisiana,5
through the Department of Transportation and Development, et al" consolidated with6
"Bo McAllister, et al v. State of Louisiana through the Department of Transportation7
and Development, et al"; and to provide for related matters.8
Be it enacted by the Legislature of Louisiana:9
Section 1. The sum of One Hundred Eighty-Five Thousand and No/10010
($185,000.00) Dollars in favor of plaintiff, Gretchen Darone, and the sum of One Hundred11
Twenty-Five Thousand and No/100 ($125,000.00) Dollars in favor of plaintiff, Amanda12
Bourland, is hereby appropriated out of the General Fund of the state of Louisiana for Fiscal13
Year 2012-2013 to be used to pay the consent judgment in the suit entitled "Gretchen14
Darone, et al v. State of Louisiana, through the Department of Transportation and15
Development, et al" consolidated with "Joseph Bayhi, Sr., et al v. State of Louisiana, through16
the Department of Transportation and Development, et al" consolidated with "Bo McAllister,17
et al v. State of Louisiana through the Department of Transportation and Development, et18
al", bearing Numbers 555,238, Section 22; 555,592, Section 8; and 555,643, Section 23; on19 HLS 12RS-823	ORIGINAL

the docket of the Nineteenth Judicial District Court, parish of East Baton Rouge, state of1
Louisiana.2
Section 2. The sum of One Hundred Twenty-Five Thousand and No/1003
($125,000.00) Dollars in favor of plaintiff, Pamela Hyde, the sum of One Hundred Thousand4
and No/100 ($100,000.00) Dollars in favor of plaintiff, Joseph Bayhi, Sr., the sum of One5
Hundred Thousand and No/100 ($100,000.00) Dollars in favor of plaintiff, Joseph Bayhi,6
Sr., on behalf of Joseph Bayhi, Jr., the sum of One Hundred Thousand and No/1007
($100,000.00) Dollars in favor of plaintiff, Joseph Bayhi, Sr., on behalf of Dustin Bayhi, and8
the sum of One Hundred Thousand and No/100 ($100,000.00) Dollars in favor of plaintiff,9
Joseph Bayhi, Sr., on behalf of Thunden Bayhi, is hereby appropriated out of the General10
Fund of the state of Louisiana for Fiscal Year 2012-2013 to be used to pay the consent11
judgment in the suit entitled "Gretchen Darone, et al v. State of Louisiana, through the12
Department of Transportation and Development, et al" consolidated with "Joseph Bayhi, Sr.,13
et al v. State of Louisiana, through the Department of Transportation and Development, et14
al" consolidated with "Bo McAllister, et al v. State of Louisiana through the Department of15
Transportation and Development, et al", bearing Numbers 555,238, Section 22; 555,592,16
Section 8; and 555,643, Section 23; on the docket of the Nineteenth Judicial District Court,17
parish of East Baton Rouge, state of Louisiana.18

($185,000.00) Dollars in favor of plaintiff, Bo McAllister, is hereby appropriated out of the20
General Fund of the state of Louisiana for Fiscal Year 2012-2013 to be used to pay the21
consent judgment in the suit entitled "Gretchen Darone, et al v. State of Louisiana, through22
the Department of Transportation and Development, et al" consolidated with "Joseph Bayhi,23
Sr., et al v. State of Louisiana, through the Department of Transportation and Development,24
et al" consolidated with "Bo McAllister, et al v. State of Louisiana through the Department25
of Transportation and Development, et al", bearing Numbers 555,238, Section 22; 555,592,26
Section 8; and 555,643, Section 23; on the docket of the Nineteenth Judicial District Court,27

Section 4. This Act shall become effective on July 1, 2012; if vetoed by the governor1
and subsequently approved by the legislature, this Act shall become effective on July 1,2
2012, or on the day following such approval by the legislature, whichever is later. 3
