ACT No. 486 Regular Session, 2012 HOUSE BILL NO. 295 BY REPRESENTATIVES WESLEY BISHOP AND SMITH AN ACT1 To amend and reenact R.S. 37:2950(A) and to enact R.S. 37:2950(D)(1)(a)(xv), (xvi), and2 (xvii), relative to employment restrictions; to provide relative to criminal record; to3 provide for exceptions; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 37:2950(A) is hereby amended and reenacted and R.S.6 37:2950(D)(1)(a)(xv), (xvi), and (xvii) are hereby enacted to read as follows: 7 ยง2950. Felony convictions' Criminal record effect on trade, occupational, and8 professional licensing9 A. Notwithstanding any other provisions of law to the contrary, a person10 shall not be disqualified, or held ineligible to practice or engage in any trade,11 occupation, or profession for which a license, permit, or certificate is required to be12 issued by the state of Louisiana or any of its agencies or political subdivisions, solely13 because of a prior criminal record, except in cases in which the applicant has been14 convicted of a felony, and such a conviction directly relates to the position of15 employment sought, or to the specific occupation, trade, or profession for which the16 license, permit, or certificate is sought.17 * * *18 ENROLLEDHB NO. 295 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions.
