HOUSE BILL NO. 320

LIBRARIES: Provides relative to the disposition of surplus library books by the Calcasieu
Parish Library
AN ACT1
To enact R.S. 25:151(B)(4) and (C)(3), relative to the Calcasieu Parish Library; to provide2
relative to the disposition of surplus library books; to authorize the library, subject3
to the approval of its governing board, to sell such books; to provide relative to the4
disposition of proceeds collected from such sales; to provide relative to the location5
of such sales; and to provide for related matters.6
Notice of intention to introduce this Act has been published7
as provided by Article III, Section 13 of the Constitution of8
Louisiana.9
Be it enacted by the Legislature of Louisiana:10
Section 1.  R.S. 25:151(B)(4) and (C)(3) are hereby enacted to read as follows: 11

(4)(a) The Calcasieu Parish Library, subject to the approval of the Calcasieu16
Parish Library Board of Control, may sell any superseded, obsolete, or otherwise17
unnecessary book in the possession of the library to any hospital, correctional18
facility, public or private institution, nonprofit organization, adult education19

(b) The proceeds collected from the sale of library books pursuant to1
Subparagraph (a) of this Paragraph shall be remitted to the Calcasieu Parish Library2
Board of Control and shall be used exclusively for the maintenance, operation, and3
support of the Calcasieu Parish Library.4

(3) The Calcasieu Parish Library may dispose of books as provided in7
Paragraph (B)(4) of this Section by making such books available for purchase at a8
convenient location to be determined by the Calcasieu Parish Library Board of9
Control.10

Section 2. This Act shall become effective on July 1, 2012; if vetoed by the governor12
and subsequently approved by the legislature, this Act shall become effective on July 1,13
2012, or on the day following such approval by the legislature, whichever is later.14

Abstract:  Relative to the Calcasieu Parish Library, to authorize the library, subject to the
approval of the Calcasieu Parish Library Board of Control, to sell surplus library
books to certain entities and to individuals. Provides relative to the location of such
sales and the disposition of proceeds.
Present law provides that each public library in the state may dispose of any superseded,
obsolete, unused, or otherwise unnecessary book by permitting it to be claimed by any
hospital, correctional facility, public or private institution, nonprofit organization, adult
education program, youth organization, school, or any individual for private use free of
charge. Present law requires a public library seeking to dispose of books as provided in
present law to do so by making all such books available to be selected for ownership in a
convenient location in the library.
Proposed law retains present law.
Present law provides an exception for the Webster Parish Library by authorizing the library,
subject to the approval of the Webster Parish Library Board of Control, to sell such books
to the above-mentioned entities.  Present law provides that the proceeds collected from such
sales shall be remitted to the Webster Parish Library Board of Control and requires that the
proceeds be used exclusively for the maintenance, operation, and support of the Webster

Proposed law retains present law and additionally authorizes the Calcasieu Parish Library
subject to the approval of the Calcasieu Parish Library Board of Control, to sell such books
to the above-mentioned entities.  Proposed law provides that the proceeds collected from
such sales shall be remitted to the Calcasieu Parish Library Board of Control and requires
that the proceeds be used exclusively for the maintenance, operation, and support of the
Calcasieu Parish Library.
Effective July 1, 2012.
