Regular Session, 2012 HOUSE BILL NO. 45 BY REPRESENTATIVE CONNICK PUBLIC SFTY/DEPARTMENT: Provides for retirement provisions upon effectiveness of transfer of CCC bridge police from DOTD to DPS&C AN ACT1 To amend and reenact R.S. 11:62(5)(f), 102(C)(1)(i), 441(F), and 612(2)(c), relative to the2 retirement benefits; to provide for retirement benefits for members of the Crescent3 City Connection police force upon transfer from the Department of Transportation4 and Development to the Department of Public Safety and Corrections; and to5 provide for related matters.6 Notice of intention to introduce this Act has been published7 as provided by Article X, Section 29(C) of the Constitution8 of Louisiana.9 Be it enacted by the Legislature of Louisiana:10 Section 1. R.S. 11:62(5)(f), 102(C)(1)(i), 441(F), and 612(2)(c) are hereby amended11 and reenacted to read as follows:12 §62. Employer contributions; determination; state systems1 * * *2 C.(1) This Subsection shall be applicable to the Louisiana State Employees'3 Retirement System effective for the June 30, 2010, system valuation and beginning4 Fiscal Year 2011-2012. For purposes of this Subsection, "plan" or "plans" shall5 mean a subgroup within the system characterized by the following employee6 classifications:7 * * *8 (i) Employees of the bridge police section of the Crescent City Connection9 Division Police Force of the Department of Transportation and Development10 Department of Public Safety and Corrections, public safety services.11 * * *12 §441. Eligibility for retirement13 * * *14 F.(1) Notwithstanding the provisions of Subsection A of this Section or any15 other provision of law to the contrary, employees of the bridge police section of the16 Crescent City Connection Division Police Force of the Department of Transportation17 and Development Public Safety and Corrections, public safety services, who are18 members of the system shall be eligible for retirement at any age upon attaining19 twenty-five or more years of service credit, at least ten of which were served20 immediately prior to application for retirement in a position with the bridge police21 section of the Crescent City Connection Division Police Force of the Department of22 Transportation and Development Public Safety and Corrections, public safety23 services.24 (2) Notwithstanding any provision of law to the contrary, members25 employed by the bridge police section of the Crescent City Connection Division of26 the Department of Transportation and Development on the effective date of this27 Paragraph, shall be governed by the provisions of this Subsection.28 * * *29 HLS 12RS-432 ORIGINAL HB NO. 45 Page 3 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. §612. Application; definitions1 Terms not specifically defined in this Section shall have the meanings2 provided in R.S. 11:403 unless a different meaning is clearly required by the context.3 For purposes of this Subpart:4 * * *5 (2) "Member" or "members" shall include the following persons whose first6 employment making them eligible for membership in one of the state systems7 occurred on or after January 1, 2011:8 * * *9 (c) Employees of the bridge police section of the Crescent City Connection10 Police Force Division of the Department of Transportation and Development of the11 Department of Public Safety and Corrections, public safety services.12 * * *13 Section 2. Proposed law provides for the retirement rate for the Bridge Police. Proposed law changes present law to the Crescent City Connection Police. Proposed law makes technical changes in retirement provisions reflecting the transfer of the police to DPS&C from DOTD. Proposed law provides that the Crescent City Connection Police shall continue under the current retirement system, notwithstanding the transfer to DPS&C.
