SECONDHAND DEALERS: Creates an exemption in the secondhand dealer law for the
purchase of musical instruments
AN ACT1
To enact R.S. 37:1861(B)(introductory paragraph) and (6), relative to secondhand dealers;2
to provide for an exemption for dealers of musical instruments; and to provide for3
related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 37:1861(B)(introductory paragraph) and (6) is hereby enacted to read6
as follows: 7
ยง1861.  "Secondhand dealer" defined8

B. Except as provided for in R.S. 37:1864.3 and 1869.1 R.S. 37:1869.1, the10
provisions of this Part shall not apply to:11

(6) Dealers in musical instruments, musical equipment, accessories, or parts.13

Abstract: Establishes an exemption for dealers of musical instruments in the definition of
"secondhand dealer".
Present law defines "secondhand dealer" as any person engaged in the business of buying,
selling, trading in, or otherwise acquiring or disposing of junk or used or secondhand

Proposed law retains present law but adds an exemption for dealers in musical instruments,
musical equipment, accessories, or parts.
