SALES/TOBACCO TRADE: Provides with respect to manufacturers of tobacco products
AN ACT1
To amend and reenact R.S. 26:901(6), relative to tobacco products; to provide for the2
definition of "manufacturer"; to provide with respect to persons who provide a3
vending machine that allows a consumer to process tobacco into a roll or tube; and4
to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 26:901(6) is hereby amended and reenacted to read as follows: 7
ยง901.  Definitions8
As used in this Chapter, the following terms have the meaning ascribed to9
them in this Section, unless the context clearly indicates otherwise:10

(6)(a) "Manufacturer" means anyone engaged in the manufacture, production,12
or foreign importation of tobacco products who sells to wholesalers.13
(b) "Manufacturer" shall also mean anyone who maintains or provides a14
vending machine at any retail establishment that enables any consumer to process15
at that establishment, tobacco or any product that is made or derived from tobacco16
into a roll or tube for sale to a consumer.17

Abstract: Provides for anyone who maintains a roll-your-own vending machine to be
considered a manufacturer for purposes of tobacco laws.
Present law defines "manufacturer" for purposes of tobacco laws.
Proposed law expands the definition of "manufacturer" to include a person who maintains
a vending machine at any retail establishment that allows a consumer to process tobacco or
any product derived from tobacco that can be made into a roll or tube for sale to the
consumer.
