GERMAIN MTR VEHICLE/COMMERCIAL: Exempts motor carriers of waste from proving public convenience and necessity AN ACT1 To amend and reenact R.S. 45:162(2) and 164(C), relative to motor carriers; to define2 "certificate"; to exempt carriers of waste from the requirement to prove public3 convenience and necessity; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 45:162(2) and 164(C) are hereby amended and reenacted to read as6 follows:7 §162. Definitions8 The following words and phrases when used in this Chapter shall have the9 meanings ascribed to them in this Section except where a different meaning is10 expressly stated or clearly indicated by the context.11 * * *12 (2) "Certificate" means a certificate of public convenience and necessity13 issued to intrastate transporters of household goods or waste, which shall not include14 transporters of salt water utilized in oil well exploration or production, by motor15 vehicle, and intrastate transporters of passengers by motor vehicle, other than16 contract carriers by bus, under R.S. 45:161 through 172.17 * * *18 §164. Present law requires a motor carrier of household goods, waste, or passengers to prove public convenience and necessity in order to obtain approval from the La. Public Service Commission to operate as a common carrier or contract carrier. Proposed law retains present law but exempts motor carriers of waste from the requirement to prove public convenience and necessity. Present law further provides that wrecker and towing services and limousine services are exempt from the requirement to prove public convenience and necessity when applying for a common carrier certificate or contract carrier permit. Proposed law retains present law and adds motor carriers of waste to the list of those carriers who are exempt from proving public convenience and necessity. (Amends R.S. 45:162(2) and 164(C))
