MTR VEHICLE/DEALERS: Provides an exemption for certain types of trailers under the
Motor Vehicle Commission provisions
AN ACT1
To amend and reenact R.S. 32:1252(37) and (45), relative to motor vehicles licensed by the2
Louisiana Motor Vehicle Commission; to provide for definitions of recreational3
product and trailer; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 32:1252(37) and (45) are hereby amended and reenacted to read as6
follows:7
ยง1252.  Definitions8
The following words, terms, and phrases, when used in this Chapter, shall9
have the meanings respectively ascribed to them in this Section, except where the10
context clearly indicates a different meaning:11

(37) "Recreational products" means new and unused motorcycles, all-terrain13
vehicles, marine products, recreational vehicles, and trailers as defined in this14
Chapter. "Recreational products" shall not mean a trailer with a gross vehicle weight15
rating of sixty-five thousand pounds or more.16

(45) "Trailer" means every single vehicle without motive power designed for18
carrying property or passengers wholly on its own structure, drawn by a motor19

and having one or more load carrying axles	, except such vehicles with a gross1
vehicle weight rating of sixty-five thousand pounds or more. "Trailer" includes but2
is not limited to utility trailers, boat trailers, recreational trailers, semitrailers,3
livestock trailers, and dump trailers.4

Abstract: Exempts those relative to the distribution or sale of trailers with a gross vehicle
weight rating of 65,000 pounds or more from licensure by the La. Motor Vehicle
Commission.
Present law requires the licensure of those persons who engage in business in the state
relative to the distribution and sale of motor vehicles, including but not limited to
manufacturers, dealers, distributors, facilities, repair centers, brokers, franchisers, lessors,
representatives, salesmen, agents, shows, and promoters.
Present law defines "recreational products" as new and unused motorcycles, all-terrain
vehicles, marine products, recreational vehicles, and trailers as defined in present law
regulating the distribution and sale of motor vehicles.
Present law defines "trailer" as every single vehicle without motive power designed for
carrying property or passengers wholly on its own structure, drawn by a motor vehicle which
carries no part of the weight and load of the trailer on its own wheels and having one or more
load carrying axles, including but not limited to utility trailers, boat trailers, recreational
trailers, semitrailers, livestock trailers, and dump trailers.
Proposed law changes the present law definitions of "recreational product" and "trailer" to
exclude trailers having a gross vehicle weight rating of 65,000 pounds or more.
Proposed law changes present law by exempting those who are manufacturers, dealers,
distributers, brokers, factory branches, factory representatives, franchisees, lease facilitators,
motor vehicle lessors, motor vehicle lessor agents, motor vehicle lessor franchisers, motor
vehicle salesmen, recreational products dealers, used motor vehicle dealers, or used motor
vehicle facilities that handle such trailers from licensure by the commission.
