Regular Session, 2012 HOUSE BILL NO. 671 BY REPRESENTATIVE SMITH WORKERS COMPENSATI ON: Provides for the payment of medical benefits AN ACT1 To amend and reenact R.S. 23:1201(E), relative to workers' compensation benefits; to2 provide for the time period for payment of medical benefits; and to provide for3 related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 23:1201(E) is hereby amended and reenacted to read as follows:6 ยง1201. Time and place of payment; failure to pay timely; failure to authorize;7 penalties and attorney fees8 * * *9 E. [R.S. 1:13(B) and 24:177(E)] Smith HB No. 671 Abstract: Provides for the time period for the payment of benefits. Present law provides that payments of compensation in workers' compensation claims shall be paid at the same place and time as wages were paid before the accident, unless the employee is not living at the same place, in which case he may provide a mailing address. Present law provides that an interval of up to a month may be given for payment, but if more than one month is needed, it must be approved by the director. Present law provides that electronic transfer of funds, including direct deposit, or payment by debit card, is also an appropriate method of payment. Present law provides that the 1 st installment of compensation for disability or death is due by the 14 th day after the employer or insurer has knowledge of the accident. Present law provides that installment benefits pursuant to the supplemental earnings benefits statute shall be due on the 14 th day after the employer or insurer has knowledge of the supplemental earnings benefits. Present law provides that the installment benefits pursuant to the permanent partial disability statute shall be due on the 30 th day after the employer or insurer receives a medical report giving notice of the disability. Present law provides that medical benefits shall be paid within 60 days after the employer or insurer receives written notice thereof. Proposed law changes the time period from 60 days to 30 days.
