Regular Session, 2012 HOUSE BILL NO. 709 BY REPRESENTATIVE BADON ELECTION CODE: Provides relative to registration and voting by certain displaced registrants AN ACT1 To amend and reenact R.S. 18:101(F), relative to voter registration and voting; to provide2 relative to qualifications for registration and voting; to provide relative to the3 residence of persons involuntarily displaced by the effects of certain states of4 emergency for such purposes; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 18:101(F) is hereby amended and reenacted to read as follows:7 ยง101. Registration to vote; qualifications; more than one residence; presidential8 elections9 * * *10 F. [R.S. 1:13(B) and 24:177(E)] Badon HB No. 709 Abstract: Places a two-year limitation on certain provisions of law relative to registrants displaced from their place of residence by the effects of a gubernatorially declared state of emergency. Present law provides relative to qualifications for registering to vote. Provides generally that every citizen of the state who is at least 18 or will attain that age on or before the next election is an actual bona fide resident of the state and the parish, municipality, if any, and precinct in which he offers to register as a voter is not disfranchised and who complies with the provisions of present law shall be eligible to register to vote in local, state, and national elections held in the state. Proposed law retains present law. Present law provides that a person who has been involuntarily displaced from his place of residence by the effects of a gubernatorially declared state of emergency shall not be considered to have vacated his residence and shall be considered to be an actual bona fide resident of the state and parish in which he is registered to vote unless he has either established a new domicile or has changed his registration to an address outside the voting district. Proposed law provides that present law will not apply after two years from the end of the declared state of emergency. Otherwise retains present law. (Amends R.S. 18:101(F))
