FIRE PROTECT/FIRE MARSHAL: Authorizes the state fire marshal to issue and enforce
burn bans
AN ACT1
To enact R.S. 40:1602, relative to the state fire marshal; to authorize the state fire marshal2
to issue a burn ban; to authorize the state fire marshal to enforce a burn ban; to3
authorize the state fire marshal to issue civil citations for violations; and to provide4
for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 40:1602 is hereby enacted to read as follows: 7
ยง1602.  Burn ban; authority of the state fire marshal; civil citation8
A.  The state fire marshal may issue an order to prohibit or limit the private9
outdoor burning of materials in any area of this state.10
B. The state fire marshal or his representative may enforce the order and11
issue a citation for violation in accordance with R.S. 40:1563.4.12
Section 2. This Act shall become effective upon signature by the governor or, if not13
signed by the governor, upon expiration of the time for bills to become law without signature14
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If15
vetoed by the governor and subsequently approved by the legislature, this Act shall become16

Proposed law authorizes the state fire marshal to issue an order to prohibit or limit the
private outdoor burning of materials in any area of this state.
Proposed law further authorizes the state fire marshal or his representative to enforce the
order and to issue a civil citation for violation.
Effective upon signature of governor or lapse of time for gubernatorial action.
