HOUSE BILL NO. 717
BY REPRESENTATIVE THOMPSON
TAX/GAMING: Dedicates a portion of the state tax on riverboats collected in boats in
Bossier and Caddo parishes to the Shreveport-Bossier Sports Commission and the
Independence Bowl
AN ACT1
To amend and reenact R.S. 27:92(B)(2)(b)(i) and (c) and R.S. 47:322.30(C) and to enact2
R.S. 27:92(B)(2)(d) and R.S. 47:322.30(D) , relative to the collection and disposition3
of fees from the conduct of gaming activities on a riverboat; to dedicate a portion of4
fees collected from certain riverboats operating within Bossier Parish and Caddo5
Parish; to provide for the uses of the Shreveport-Bossier City Visitor Enterprise6
Fund; and to provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 27:92(B)(2)(b)(i) and (c) are hereby amended and reenacted and R.S.9
27:92(B)(2)(d) is hereby enacted to read as follows: 10

(2) After complying with the provisions of Paragraph (1) of this Subsection,15
the state treasurer shall, each fiscal year, credit the following amounts to the16
following funds:17

(b)(i) Except as provided in Item (ii) of this Subparagraph and Subparagraph1
(d) of this Paragraph, the franchise fee paid pursuant to R.S. 27:91(C)(1) to the state2
general fund.3

(c) To a special fund, which is hereby created in the state treasury and5
entitled the Riverboat Gaming Enforcement Fund, an amount equal to the revenues6
received by the state pursuant to this Chapter, less any monies credited to other funds7
pursuant to the provisions of Subparagraphs (a) and (b) (a), (b), and (d) of this8
Paragraph.9
(d)(i) Two and one-half percent of the franchise fees paid pursuant to R.S.10
27:91(C)(1) which is attributable to any riverboat gaming license operating in Caddo11
Parish or Bossier Parish to the Shreveport-Bossier City Visitor Enterprise Fund, as12
provided in R.S. 47:322.30.13
(ii) Two and one-half percent of the license fees paid pursuant to R.S.14
27:91(B)(2) which is attributable to any riverboat gaming license operating in Caddo15
Parish or Bossier Parish to the Shreveport-Bossier City Visitor Enterprise Fund, as16
provided in R.S. 47:322.30.17
(iii) Six and one-half percent of the franchise fee paid pursuant to R.S.18
27:91(C)(1) which is attributable to any riverboat gaming licensee in Caddo Parish19
or Bossier Parish not in operation prior to July 1, 2012, which subsequently begins20
operation on or after July 1, 2012, to the Shreveport-Bossier City Visitor Enterprise21
Fund, as provided in R.S. 47:322.30.22
(iv) Six and one-half percent of the license fee paid pursuant to R.S.23
27:91(B)(2) which is attributable to any riverboat gaming licensee in Caddo Parish24
or Bossier Parish not in operation prior to July 1, 2012, which subsequently begins25
operation on or after July 1, 2012, to the Shreveport-Bossier City Visitor Enterprise26
Fund, as provided in R.S. 47:322.30.27

Section 2. R.S. 47:322.30(C) is hereby amended and reenacted and R.S.1
47:322.30(D) is hereby enacted to read as follows: 2
§322.30. Disposition of certain collections in the cities of Shreveport and Bossier3

C. Notwithstanding any provision of law to the contrary, monies deposited6
in this fund from the avails of the fees  paid pursuant to R.S. 27:92(B)(2)(d)7
attributable to any riverboat gaming license operating in Caddo Parish or Bossier8
Parish shall be appropriated each year by the legislature as follows:9
(1)(a) Fifty percent to the Shreveport-Bossier Sports Commission.10
(b) Fifty percent to the Independence Bowl Foundation, Inc.11
(2) In the event either the Shreveport-Bossier Sports Commission or the12
Independence Bowl are abolished or in any other way cease to exist, one hundred13
percent shall be appropriated to the remaining entity. In the event both the14
Shreveport-Bossier Sports Commission and the Independence Bowl are abolished15
or in any other way cease to exist, one hundred percent to the Shreveport-Bossier16
Convention and Tourist Bureau.17
D. All unexpended and unencumbered monies remaining in the fund at the18
end of the fiscal year shall remain in the fund. The monies in the fund shall be19
invested by the treasurer in the same manner as the monies in the state general fund,20
and all interest earned shall be deposited in the state general fund.21
Section 3. This Act shall become effective July 1, 2012; if vetoed by the governor22
and subsequently approved by the legislature, this Act shall become effective on July 1,23
2012, or on the day following such approval by the legislature, whichever is later.24 HLS 12RS-232	ORIGINAL

Abstract: Dedicates state revenues from riverboat gaming operations in Bossier and Caddo
parishes to the Shreveport-Bossier Sports Commission and the Independence Bowl.
Present law (R.S. 27:91) provides for certain fees on riverboat gaming licensees including:
(1) A license fee of 3.5% of net gaming proceeds.
(2) A franchise fee of 15% of net gaming proceeds.
(3) An additional franchise fee of 3% of net gaming proceeds.
Present law requires that the fees on riverboat gaming licensees be deposited into the
Compulsive Problem and Gaming Fund, the state general fund, the Support Education in La.
First Fund (the SELF Fund), and the Riverboat Gaming Enforcement Fund.
Present law requires that the franchise fee of 15% of net riverboat gaming proceeds be
deposited into the state general fund, excluding 9% of the 15% which is to be deposited into
the SELF Fund.
Proposed law retains present law on revenues deposited into the Compulsive Problem and
Gaming Fund and the SELF Fund.
Proposed law requires that 2.5% of the 15% franchise fee which is attributable to any
riverboat gaming license operating in Caddo Parish or Bossier Parish be deposited into the
Shreveport-Bossier City Visitor Enterprise Fund.
Present law requires that 9% of the license fee of 3.5% of net riverboat gaming proceeds be
deposited into the SELF Fund.
Proposed law retains present law and requires that 2.5% of the 3.5% license fee which is
attributable to any riverboat gaming license operating in Caddo Parish or Bossier Parish be
deposited into the Shreveport-Bossier City Visitor Enterprise Fund.
Present law creates the Riverboat Gaming Enforcement Fund and provides that an amount
equal to the revenues received from riverboat gaming proceeds less certain monies credited
to the Compulsive and Problem Gaming Fund, the SELF Fund and the state general fund.
Proposed law retains present law and further adds monies credited to the Shreveport-Bossier
City Visitor Enterprise Fund pursuant to proposed law.
Proposed law provides 6.5% of the 15% license fee which is attributable to any riverboat
gaming licensee in Caddo Parish or Bossier Parish not in operation prior to July 1, 2012,
which subsequently begins operation on or after July 1, 2012, be dedicated to the
Shreveport-Bossier City Visitor Enterprise Fund.
Proposed law provides 6.5% of the 3.5% franchise fee which is attributable to any riverboat
gaming licensee in Caddo Parish or Bossier Parish not in operation prior to July 1, 2012,
which subsequently begins operation on or after July 1, 2012, be dedicated to the

Present law creates the Shreveport-Bossier City Visitor Enterprise Fund and provides that
the monies in the fund are available exclusively for use by the Shreveport-Bossier
Convention and Tourist Bureau for the purpose of promoting and enhancing tourism
activities.
Proposed law retains present law and further provides that monies deposited into the fund
attributable to riverboat gaming license and franchise fees paid in Caddo Parish or Bossier
Parish shall be appropriated as follows:
(1) 50% to the Shreveport-Bossier Sports Commission.
Proposed law sunsets Dec. 31, 2014, unless reenacted by the legislature.
(2) 50% to the Independence Bowl Foundation, Inc.
Proposed law further provides that in the event either the Shreveport-Bossier Sports
Commission or the Independence Bowl are abolished then, 100% of such monies shall be
appropriated to the other entity.
Proposed law further provides that in the event both the Shreveport-Bossier Sports
Commission and the Independence Bowl are abolished then, 100% of such monies shall be
appropriated to the Shreveport-Bossier Convention and Tourist Bureau.
Effective July 1, 2012.
