AN ACT1
To amend and reenact R.S. 13:5073(A)(1), relative to the certification of tobacco product2
manufacturers; to provide for a fee for certification for tobacco product3
manufacturers; to provide for the use of the fees; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 13:5073(A)(1) is hereby amended and reenacted to read as follows:6
ยง5073. Certifications; directory; tax stamps7
A.(1) Every tobacco product manufacturer whose cigarettes are sold in this8
state, whether directly or through a distributor, retailer, or similar intermediary or9
intermediaries, shall execute and deliver on a form prescribed by the attorney general10
a certification to the secretary and attorney general, no later than the thirtieth day of11
April each year, certifying under penalty of perjury that, as of the date of such12
certification, such tobacco product manufacturer either: is a participating13
manufacturer; or is in full compliance with R.S. 13:5061 et seq., including all14
installment payments required by R.S. 13:5075(E). For the initial certification15
submitted no later than the thirtieth of April each year, a manufacturer shall pay to16
the attorney general a fee of five hundred dollars. The fees generated pursuant to this17
Section shall be deposited in the Tobacco Settlement Enforcement Fund and used 18 ENROLLEDHB NO. 721

solely and exclusively for purposes of enforcement of the Master Settlement1
Agreement, pursuant to R.S. 39:98.7.2
