HOUSE BILL NO. 722
BY REPRESENTATIVE PYLANT
APPROPRIATIONS/JUDGMENT:  Appropriates funds for payment of judgment against
the Dept. of Transportation and Development in the matter of "John M. Byrd, et al
v. State of Louisiana" consolidated with "Jerry Starr, et al v. State of Louisiana"
AN ACT1
To appropriate funds out of the General Fund of the state of Louisiana for Fiscal Year 2012-2
2013 to be used to pay the judgment in the suit entitled "John M. Byrd, Eugene3
Moore, Chris Navarro and Joseph Michael Williams v. State of Louisiana, through4
the Department of Transportation and Development" consolidated with "Jerry Starr,5
individually and on behalf of his minor daughter Jamie Starr v. State of Louisiana,6
through the Department of Transportation and Development"; to provide for interest;7
to provide for court costs; and to provide for related matters.8
Be it enacted by the Legislature of Louisiana:9
Section 1.A. The sum of Eight Hundred Thirty-Nine Thousand Two Hundred10
Ninety-One and 92/100 ($839,291.92) Dollars in favor of Hilton Eugene Moore; the sum of11
Seventy-Two Thousand Two Hundred Eighty-Six and 89/100 ($72,286.89) Dollars in favor12
of Christopher Navarro; the sum of Twelve Thousand and No/100 ($12,000.00) Dollars in13
favor of John Byrd; the sum of Eighteen Thousand Six Hundred Eighteen and 95/10014
($18,618.95) Dollars in favor of Joseph Williams; the sum of Thirty-Six Thousand and15
No/100 ($36,000.00) Dollars in favor of the Estate of Jamie Starr; and the sum of Six16
Thousand and No/100 ($6,000.00) Dollars in favor of Jerry Starr; all amounts plus legal17
interest and court costs, are hereby appropriated out of the General Fund of the state of18
Louisiana for Fiscal Year 2012-2013 to be used to pay the judgment in the suit entitled "John19
M. Byrd, Eugene Moore, Chris Navarro and Joseph Michael Williams v. State of Louisiana,20 HLS 12RS-483	ORIGINAL

through the Department of Transportation and Development" consolidated with "Jerry Starr,1
individually and on behalf of his minor daughter Jamie Starr v. State of Louisiana, through2
the Department of Transportation and Development", bearing Numbers 24606 and 24602,3
respectively, on the docket of the Thirty-Seventh Judicial District Court, parish of Caldwell,4
state of Louisiana; and bearing Nos. 46,226-CA and 46,227-CA, respectively, on the Second5
Circuit Court of Appeal.6
B. Monies awarded in this judgment to Hilton Eugene Moore for future medical7
expenses shall be payable as incurred from the Future Medical Care Fund pursuant to R.S.8
39:1533.2.9
Section 2.  The judgment provided for in Section 1 hereof shall be deemed to have10
been paid on the effective date of this Act and legal interest shall cease to run as of that date.11
Section 3. This Act shall become effective on July 1, 2012; if vetoed by the governor12
and subsequently approved by the legislature, this Act shall become effective on July 1,13
2012, or on the day following such approval by the legislature, whichever is later. 14

Appropriates from the state general fund for FY 2012-2013 the sum of $984,197.76, plus
interest and court costs, to pay the judgment in "John M. Byrd, et al v. DOTD" c/w "Jerry
Starr, et al v. DOTD", bearing nos. 24606 and 24602, respectively, on the docket of the 37th
JDC, parish of Caldwell, and nos. 46,226-CA and 46,227-CA, respectively, on the 2nd
Circuit Court of Appeal. Monies awarded for future medical expenses shall be paid from
the Future Medical Care Fund.
Effective July 1, 2012.
