HIGHER ED/BD REGENTS: Provides for powers, duties and functions of the Board of
Regents
AN ACT1
To amend and reenact R.S. 17:3128(A) and (B)(2), relative to distribution of funds for2
postsecondary education; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1. R.S. 17:3128(A) and (B)(2) are hereby amended and reenacted to read as5
follows: 6
ยง3128.  Power to formulate master plan; mission establishment7
A. The Board of Regents shall have the power to formulate and make timely8
revision of a master plan for postsecondary education. As a minimum, the plan shall9
include a formula for equitable distribution of funds to the institutions of10
postsecondary education. Equitable for purposes of the distribution formula means11
equitable as the institutions are compared to their respective Southern Regional12
Education Board peer averages unless an institution fails to meet the applicable13
performance requirements established pursuant to R.S. 17:3139 et seq. The board14
shall submit its plan and formula for funding to the governor and the legislature.15

(2) The Board of Regents shall make such recommendations for legislative19

institution as provided in its mission statement.  The formula for equitable1
distribution of funds shall be developed with strong consideration for institutional2
mission as an overriding factor in resource allocation, and no institution that is3
fulfilling its mission shall be penalized in such formula based on a comparative4
evaluation of missions.  The management boards in conjunction with the Board of5
Regents shall develop not less than three performance allocation models based upon6
institutional type, mission, students served, and alignment with the performance7
requirements established pursuant to R.S. 17:3139 et seq.  Specifically, by way of8
example but not limitation, given the open admissions policies of community and9
technical colleges, such institutions shall be funded for all credit enrollments without10
regard to the letter grade earned for the credit by a student. Annually, the board shall11
report to the legislature and the governor on the status of higher education relative12
to the mission statements, including in such report all revisions since the last report13
and any recommendations for legislative or gubernatorial action.14

Section 2. The management boards in conjunction with the Board of Regents shall16
develop the performance allocation models required by R.S. 17:3128(B)(2) as amended by17
this Act by not later than the beginning of the 2014 fiscal year.18

Abstract: Requires the Board of Regents to make recommendations necessary to support
the development of postsecondary education public university systems and
institutions. Provides relative to distribution of funds.  Requires the board to report
the status of higher education relative to the mission statements of each system and
institution.
Proposed law retains present law and requires that the institutional mission shall be
considered to derive equitable funding of the systems and institutions.  Requires that no
institution shall receive less funding as a result of meeting its institutional mission. Further
requires that two-year colleges shall be funded for all credit enrollments.
