AN ACT1
To amend and reenact R.S. 44:4(16)(introductory paragraph) and to enact R.S. 44:4(16)(e)2
and (f), relative to public records; to provide relative to records of boards or3
institutions of higher learning; to exempt certain records from the Public Records4
Law; to provide for effectiveness; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 44:4(16)(introductory paragraph) is hereby amended and reenacted7
and R.S. 44:4(16)(e) and (f) are hereby enacted to read as follows: 8
ยง4.  Applicability9
This Chapter shall not apply:10

(16) To the following records of a board or institution of higher learning, in12
accordance with rules and regulations promulgated by the Board of Trustees for State13
Colleges and Universities, Supervisors for the University of Louisiana System, the14
Board of Supervisors of Louisiana State University and Agricultural and Mechanical15
College, and the Board of Supervisors of Southern University and Agricultural and16
Mechanical College, or their successors, in conjunction with the Board of Regents,17
for programs and institutions under their supervision and management, unless access18
to the records is specifically required by state or federal statute or is ordered by a19
court under rules of discovery:20

(e) Test questions, scoring keys, and other examination data pertaining to the22

(f) Teaching materials used by faculty that are not provided to students,1
including unpublished lecture notes, outlines, slides, syllabi, or recordings.2

Section 2. This Act shall become effective upon signature by the governor or, if not4
signed by the governor, upon expiration of the time for bills to become law without signature5
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If6
vetoed by the governor and subsequently approved by the legislature, this Act shall become7
effective on the day following such approval.8
