Regular Session, 2012 HOUSE BILL NO. 760 BY REPRESENTATIVE NANCY LANDRY BONDS/BAIL: Provides that bail for a crime of violence shall be revoked upon subsequent arrest AN ACT1 To enact Code of Criminal Procedure Article 334.4, relative to bail; to provide for the2 automatic revocation of bail for a crime of violence upon subsequent arrest; to3 prohibit the granting of bail for subsequent arrests following a revocation of bail for4 a crime of violence; to provide for criteria; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. Code of Criminal Procedure Article 334.4 is hereby enacted to read as7 follows: 8 Art. 334.4. Automatic revocation of bail upon subsequent arrest; certain offenses9 A. Notwithstanding any other provision of law to the contrary, bail for the10 commission of a crime of violence shall be immediately revoked when both of the11 following occur:12 (1) A person has been arrested for a crime of violence as defined in R.S.13 14:2(B) and is released on any type of bail for that offense.14 (2) The person is subsequently arrested for any criminal offense.15 B. Present law provides for the setting of bail by the court. Proposed law retains present law and further provides that bail shall be immediately revoked when a person has been released on bail for the commission of a crime of violence and is subsequently arrested for any criminal offense. Proposed law further provides that bail shall not be granted for the subsequent offense for which the person is arrested following the revocation of bail for the crime of violence. (Adds C.Cr.P.
