MEDICAID: Requires the Dept. of Health and Hospitals to implement an equitable system
of Medicaid reimbursement to private hospitals and to state hospitals respectively
AN ACT1
To enact R.S. 36:254(A)(15), relative to powers and duties of the secretary of the2
Department of Health and Hospitals; to provide for requirements of the Medical3
Assistance Program; to provide for a system of reimbursement by the Medical4
Assistance Program; to provide for reporting; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 36:254(A)(15) is hereby enacted to read as follows: 7
ยง254. Powers and duties of the secretary of the Department of Health and Hospitals8
A. In addition to the functions, powers, and duties otherwise vested in the9
secretary by law, he shall:10

(15) Implement an equitable system of total annual reimbursement by the12
Medical Assistance Program to private hospitals and to state hospitals for covered13
services delivered to program clients at those two categories of facilities14
respectively. The secretary shall implement such system in a manner which15
maximizes access to health care by persons who are medically needy in this state.16
The secretary shall report on such system in the publication entitled "Louisiana17
Medicaid Annual Report" or any successor to that publication.18

Abstract: Requires the DHH to implement an equitable system of total annual Medicaid
reimbursement to private hospitals and to state hospitals respectively.
Proposed law retains present law which provides for duties of the secretary of DHH.
Proposed law adds to such duties the implementation of an equitable system of total annual
medicaid reimbursement to private hospitals and to state hospitals. Provides that such
system be implemented in a manner which maximizes access to health care by persons who
are medically needy. Provides that the secretary report on such system in the "La. Medicaid
Annual Report" or any successor publication.
