TRAFFIC/VIOLATIONS: Limits types of citations which can be issued from camera
systems
AN ACT1
To enact R.S. 32:43, relative to automated enforcement systems; to limit the types of2
citations which can be issued from camera systems; and to provide for related3
matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 32:43 is hereby enacted to read as follows:6
ยง43.  Automated enforcement system; prohibition; speed7
A. No local governmental subdivision, political subdivision, or any agency8
or department thereof, shall utilize any automated enforcement system on any9
highway in this state to issue a citation or violation to, or to impose or collect a civil10
or criminal fine, fee, or penalty on, a person for operating a motor vehicle which11
exceeds the posted speed limit unless such motor vehicle is being operated at a speed12
in excess of ten miles per hour over the posted speed limit, except in a school speed13
zone.14
B. For the purposes of this Section, the term "automated enforcement15
system", means a camera or an optical device erected alongside a public road, street,16
or highway, or at a traffic light intersection and installed to work in conjunction with17
a traffic control signal or radar speed detection equipment, or both, and designed to18
photographically record images of the license plate or other identifying feature of a19

signal or a posted traffic sign. The term shall also mean a camera or optical device1
which is attached to a vehicle parked along a public road, street, or highway, and2
installed to work in conjunction with a traffic control signal or radar speed detection3
equipment, or both.4

Abstract: Prohibits the issuance of traffic citations from a traffic camera system for a
violation less than 10 miles over the posted speed limit in this state.
Proposed law prohibits use by any local governmental subdivision or political subdivision
or any agency or department thereof, of any automated enforcement system to issue a
citation or violation for speed except when the motor vehicle is exceeding the posted speed
limit by more than 10 miles per hour, except in a school zone.
