MEDICAID: Requires the Medicaid program to reimburse providers for the vagus nerve
stimulator and similar devices at rates which equal at least the cost of such devices
AN ACT1
To enact Chapter 56-A of Title 46 of the Louisiana Revised Statutes of 1950, to be2
comprised of R.S. 46:2725 and 2726, relative to medical equipment covered by the3
Medicaid program; to establish minimum Medicaid reimbursement rates for certain4
covered medical equipment; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. Chapter 56-A of Title 46 of the Louisiana Revised Statutes of 1950,7
comprised of R.S. 46:2725 and 2726, is hereby enacted to read as follows: 8
CHAPTER 56-A.  REIMBURSEMENT FOR ESSENTI AL MEDICAL EQUIPMENT9
§2725.  Purpose10
The purpose of this Chapter is to remove unnecessary obstacles to treatment11
of Louisiana Medicaid recipients when such treatment includes durable medical12
equipment certified as "reasonable and necessary" pursuant to any Nationally13
Covered Indications issued by the Centers for Medicare and Medicaid Services of14
the United States Department of Health and Human Services, referred to hereafter15
in this Chapter as "CMS".16
§2726.  Devices used in the treatment of seizures; reimbursement rate17
The Department of Health and Hospitals shall ensure that when a health care18
provider participating in the Medicaid program implants a vagus nerve stimulator or19

patient with medically refractory partial onset seizures for whom surgery is not1
recommended or for whom surgery has failed, that provider shall be reimbursed for2
such device at a rate which is at least equal to the cost of the device.3

Proposed law provides that the purpose of proposed law is to remove unnecessary obstacles
to treatment of Medicaid recipients when such treatment includes durable medical equipment
certified as "reasonable and necessary" by the federal Medicaid agency.
Proposed law provides that DHH shall reimburse providers for the vagus nerve stimulator
or other device which is reasonable and necessary for treatment of certain types of seizures
at a rate which is at least equal to the cost of the device.
