AN ACT1
To amend and reenact the heading of Part II-A of Chapter 7 of Title 40 of the Louisiana2
Revised Statutes of 1950 and R.S. 40:1541 and to enact R.S. 36:651(S), relative to3
firemen training and certification; to create the Louisiana Fire and Emergency4
Training Commission and provide for its membership, powers, and duties; to provide5
for an effective date; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 36:651(S) is hereby enacted to read as follows:8
§651. Transfer of boards, commissions, departments, and agencies to Department9
of Education; boards, commissions, and agencies within Department of10
Education11

S. The Louisiana Fire and Emergency Training Commission (R.S. 40:1541)13
shall be within the Department of Education as provided in R.S. 40:1541.14
Section 2. The heading of Part II-A of Chapter 7 of Title 40 of the Louisiana Revised15
Statutes of 1950 and R.S. 40:1541 are hereby amended and reenacted to read as follows: 16
PART II-A.  FIREMEN; TRAINING AND CERTIFICATION;17
LOUISIANA STATE UNIVERSITY; LOUISIANA FIRE AND EMERGENCY18
TRAINING COMMISSION19
§1541.  Louisiana State University; official agency for training20
A.  Louisiana State University is hereby officially designated as the agency21

a statewide basis whereby in which firemen from any and all duly constituted fire1
departments may participate, and to coordinate and conduct other firemen training2
programs at other training locations as provided in this Part; provided, however, that3
this.  This Part shall not be construed as affecting the authority of any fire4
department to conduct training for their its own personnel.5
B. Louisiana State University shall conduct training programs and perform6
its functions as provided in this Part with the advice and guidance of the Louisiana7
Fire and Emergency Training Commission created by this Section.8
C.(1) The Louisiana Fire and Emergency Training Commission, referred to9
in this Part as the "commission", is hereby created.10
(2)  The commission shall be composed of nine members as follows:11
(a)  One member shall be the state fire marshal or his designee.12
(b) One member shall be the Louisiana State University-Baton Rouge13
chancellor or his designee.14
(c) Two members shall be selected by the Louisiana State Firemen's15
Association.16
(d) Two members shall be selected by the Louisiana State Fire Chief's17
Association.18
(e) Two members shall be selected by the Professional Firefighters'19
Association of Louisiana.20
(f) One member shall be a Louisiana citizen with knowledge and experience21
in the field of fire and emergency services appointed by the governor.22
(3) Members shall serve at the pleasure of the appointing authority.  A23
vacancy shall be filled in the manner of the original appointment.24
(4) Members shall serve without compensation or reimbursement for25
expenses.26
(5) The commission annually, at the first meeting of the calendar year, shall27
elect from its members a chairman and vice chairman. The chairman and vice28
chairman shall serve as such for a period of one year from the date of election.29 ENROLLEDHB NO. 818

(6) Commission members shall be considered state officers for purposes of1
R.S. 9:2798.1 and Chapter 16-A of Subtitle III of Title 39 of the Louisiana Revised2
Statutes of 1950.3
(7) The commission shall meet at least once each month.  Other meetings4
may be called by the chairman on his own initiative and shall be called by him at the5
request of three or more members of the commission within fourteen days of such6
request. Each member shall be notified by the chairman in writing of the time and7
place of a meeting at least seven days before the meeting.8
(8) The commission shall adopt rules for the conduct of commission9
functions. Any decision of the commission may be made only by the favorable vote10
of at least two-thirds of those members in attendance at the meeting provided that a11
quorum is established prior to the vote.  A majority of members of the commission12
shall constitute a quorum.13
D.(1) The Louisiana Fire and Emergency Training Commission shall advise14
and provide guidance to Louisiana State University relative to the conduct of training15
programs and performance of the university's functions pursuant to this Part.16
(2) The commission shall provide advice and guidance to the university17
relative to but not limited to the following:18
(a) Hiring a qualified person to serve as executive director, including review19
of candidates for the position, and fixing the salary of and defining the duties of the20
executive director.21
(b) Employment of clerical, technical, legal, and other assistance for the22
conduct of the university's functions pursuant to this Part.23
(c) All aspects of the conduct of fire and emergency training, including24
curricula.25
(d)  Prioritization of training throughout the state.26
(e) The annual budget for the conduct of the university's functions pursuant27
to this Part, including management of funds and recovery of the cost of classes.28
(f) Recommendations to be made by the university to the legislature relative29
to the university's functions pursuant to this Part.30 ENROLLEDHB NO. 818

Section 3. This Act shall become effective on July 1, 2012; if vetoed by the governor1
and subsequently approved by the legislature, this Act shall become effective on July 1,2
2012, or on the day following such approval by the legislature, whichever is later.3
