HOUSE BILL NO. 819
BY REPRESENTATIVE GIROD JACKSON
PUBLIC CONTRACTS: Requires the Office of Coastal Protection and Restoration to
ensure compliance with federal mandates in the use of federal funds for coastal
restoration and protection projects
AN ACT1
To enact R.S. 49:214.6.2(C)(5), relative to coastal restoration projects; to provide for use of2
federal monies on projects; to ensure that federal guidelines for use of federal monies3
are complied with; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 49:214.6.2(C)(5) is hereby enacted to read as follows:6
ยง214.6.2.  Functions and responsibilities; coastal activities7

C.  The office shall:9
(1) Receive all monies appropriated from the Coastal Protection and10
Restoration Fund to the Office of Coastal Protection and Restoration for11
implementation of all programs and projects contained in an annual plan developed12
by the Coastal Protection and Restoration Authority and approved by the legislature,13
except that the Department of Natural Resources, office of coastal management, shall14
receive any funds allocated in the annual plan for the coastal zone management15
program.16
(2) Have oversight over the administration of all matters related to the study,17
planning, engineering, design, construction, extension, improvement, repair, and18

(3) Take such other actions not inconsistent with law as are necessary to1
perform the functions of the office.2
(4) Utilize the services of the Department of Natural Resources, office of3
management and finance, for accounting and budgetary control, procurement and4
contractual management, data processing, management and program analysis,5
personnel management and grants management, provided that the secretary of the6
Department of Natural Resources shall exercise no authority over the provision of7
these services.8
(5) Ensure that projects funded wholly or in part with federal monies meet9
all federal guidelines and criteria associated with the use of the monies.10

Abstract: Requires the Office of Coastal Protection and Restoration to ensure that all
projects funded wholly or in part with federal monies comply with any federal
guidelines and criteria associated with the use of the federal monies.
Present law provides that the Office of Coastal Protection and Restoration shall administer
the programs of the Coastal Protection and Restoration Authority and shall implement
projects relative to the protection, conservation, enhancement, and restoration of the coastal
area of the state through oversight of integrated coastal projects and programs.
Present law also provides that the office shall:
(1)Receive all monies appropriated from the Coastal Protection and Restoration Fund
to the Office of Coastal Protection and Restoration for implementation of all
programs and projects contained in an annual plan developed by the Coastal
Protection and Restoration Authority and approved by the legislature, except that the
Dept. of Natural Resources, office of coastal management, shall receive any funds
allocated in the annual plan for the coastal zone management program.
