TRAFFIC/VIOLATIONS: Provides that traffic citations cannot be issued for certain traffic
maneuvers pertaining to school buses
AN ACT1
To amend and reenact R.S. 32:80(C), relative to overtaking of school buses; to provide that2
certain traffic citations cannot be written for certain traffic maneuvers taken to pass3
a school bus; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 32:80(C) is hereby amended and reenacted to read as follows:6

C. The driver of a vehicle upon a highway with separate roadways need not9
stop upon meeting or passing a school bus which is on a different roadway or when10
upon a controlled access highway and the school bus is stopped in a loading zone11
which is a part of or adjacent to such highway and where pedestrians are not12
permitted to cross the roadway. A traffic citation, including a civil citation written13
pursuant to a local or municipal ordinance, shall not be issued in the following14
circumstances:15
(1) The driver of a motor vehicle is upon a highway with separate roadways16
and does not stop upon meeting or passing a school bus which is on a separate17

(2) The driver of a motor vehicle is on a controlled access highway and1
passes a school bus stopped in a loading zone which is a part of or adjacent to such2
highway and where pedestrians are not permitted to cross the highway.3

Present law provides that the driver of a vehicle upon a highway with separate roadways
need not stop upon meeting or passing a school bus which is on a different roadway or when
upon a controlled access highway and the school bus is stopped in a loading zone which is
a part of or adjacent to such highway and where pedestrians are not permitted to cross the
roadway.
Proposed law provides that a traffic citation, including a civil citation written pursuant to a
local or municipal ordinance, shall not be issued in the following circumstances:
(1)The driver of a motor vehicle is upon a highway with separate roadways and does
not stop upon meeting or passing a school bus which is on a separate roadway.
(2)The driver of a motor vehicle is on a controlled access highway and passes a school
bus stopped in a loading zone which is a part of or adjacent to such highway and
where pedestrians are not permitted to cross the highway.
