CRIMINAL/RECORDS: Repeals the requirement that fingerprints shall be forwarded to
the FBI for a national criminal history check of certain potential employees
AN ACT1
To amend and reenact R.S. 15:587(F)(1), relative to criminal background checks; to remove2
the requirement that the Louisiana Bureau of Criminal Identification and Information3
forward fingerprints of certain persons seeking employment to the Federal Bureau4
of Investigation for a national criminal history check; and to provide for related5
matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 15:587(F)(1) is hereby amended and reenacted to read as follows:8
ยง587. Duty to provide information; processing fees; Louisiana Bureau of Criminal9
Identification and Information10

F.(1) An employer or his representative shall be entitled to obtain conviction12
records of an applicant seeking employment, directly from the Bureau of Criminal13
Identification and Information in order to further qualify the applicant for the14
position being sought, if the applicant has signed a consent form authorizing the15
employer to obtain such conviction records.  Upon written request and upon16
presentation of a consent form prepared by the bureau and executed by the applicant,17
the bureau shall provide conviction records of the applicant to the employer or his18
representative in a timely manner. In addition, each applicant shall be fingerprinted,19

Investigation for a national criminal history check. Records obtained pursuant to the1
provisions of this Subsection shall not include those records which have been2
ordered expunged pursuant to R.S. 44:9.  The provisions of Subsection B of this3
Section shall apply to any request made pursuant to this Subsection.  The bureau4
shall not be liable civilly or criminally for the release of information released5
pursuant to the provisions of this Subsection.6

Abstract: Repeals the requirement that the La. Bureau of Identification and Information
shall forward fingerprints of certain persons seeking employment obtained for
background checks to the FBI for a national criminal history check.
Present law provides that an employer or his representative shall be entitled to obtain
conviction records of an applicant seeking employment from the Bureau of Criminal
Identification and Information if the applicant has signed a consent form authorizing the
employer to obtain such conviction records.
Proposed law retains present law.
Present law further provides that the La. Bureau of Identification and Information shall
forward fingerprints obtained for those background checks to the FBI for a national criminal
history check.
Proposed law repeals this provision of present law.
(Amends R.S. 15:587(F)(1))
