HIGHER EDUCATION: Authorizes postsecondary education management boards to grant
resident status for tuition purposes for distance learning and out-of-state commuters
AN ACT1
To enact R.S. 17:3351(F), relative to the authority of postsecondary education management2
boards to grant resident status for certain tuition purposes; to authorize the granting3
of such status for distance learning and for out-of-state commuters; to provide for4
applicability and implementation; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 17:3351(F) is hereby enacted to read as follows: 7
ยง3351.  General powers, duties, and functions of college and university boards8

F.(1) Each postsecondary education management board shall have authority10
to grant resident status for the following purposes to students who are not residents11
of Louisiana and who otherwise are not eligible for such status:12
(a) Tuition amounts to be paid for distance learning.  For purposes of this13
Paragraph, "distance learning" means instruction via the internet.14
(b) Tuition amounts to be paid for instruction received by an out-of-state15
commuter. For purposes of this Paragraph, an "out-of-state commuter" means a16
student who is a resident of another state and who travels from his residence on a17
daily basis to attend instruction for which tuition is charged.18
(2) This Subsection is not applicable to instruction at the post-baccalaureate19

(3) The Board of Regents and each postsecondary system management board1
may adopt rules necessary to provide for the implementation of this Subsection.2
(4) This Subsection shall be applicable to tuition charges beginning with the3
2012-2013 academic year.4
Section 2. This Act shall become effective upon signature by the governor or, if not5
signed by the governor, upon expiration of the time for bills to become law without signature6
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If7
vetoed by the governor and subsequently approved by the legislature, this Act shall become8
effective on the day following such approval.9

Abstract: Authorizes postsecondary education management boards to grant resident status

Proposed law grants each postsecondary education management board (includes the LSU,
SU, and UL boards of supervisors and the Board of Supervisors for Community and
Technical Colleges) authority to grant resident status to students who are not residents of
Louisiana and who otherwise are not eligible for such status for purposes of:
(1)Tuition for distance learning. Defines "distance learning" as instruction via the
Internet.
(2)Tuition for instruction received by an out-of-state commuter. Defines "out-of-state
commuter" as a student who travels from his residence outside of La. on a daily basis
to attend instruction for which tuition is charged.
Proposed law is not applicable to instruction at the post-baccalaureate degree or professional
school level.  Proposed law is applicable beginning with the 2012-2013 academic year.
Proposed law authorizes the Board of Regents and each management board to adopt rules
necessary for implementation.
Effective upon signature of governor or lapse of time for gubernatorial action.
