HOUSE BILL NO. 875
BY REPRESENTATIVE HUNTER
PUBLIC MEETINGS:  Provides relative to certain actions taken by certain
nongovernmental entities and their governing bodies
AN ACT1
To enact R.S. 42:22.1, relative to the Open Meetings Law; to provide relative to actions2
taken by certain nongovernmental entities and their governing bodies; to require3
certain records of meetings related to such nongovernmental entities; to provide and4
authorize certain actions relative to certain grievances over actions taken by such5
nongovernmental entities or their governing bodies; and to provide for related6
matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 42:22.1 is hereby enacted to read as follows: 9
ยง22.1.  Meetings of certain nongovernmental entities; records; grievances; relief10
A. The provisions of this Section shall apply to each nongovernmental entity11
to which all of the following apply:12
(1) The nongovernmental entity is subject to the provisions of this Chapter.13
(2) Employees of the nongovernmental entity are authorized by law to be14
members of a state or statewide retirement system.15
(3) The nongovernmental entity is subject to audit by the legislative auditor16
pursuant to R.S. 24:513.17
B. The governing body of each nongovernmental entity subject to the18
provisions of this Section shall cause a transcript to be made of each meeting of the19

shall be available upon request in the same manner as copies of records of public1
bodies pursuant to the Public Records Law.2
C.(1) Any person aggrieved by any action taken by a nongovernmental entity3
subject to the provisions of this Section or the governing body of such a4
nongovernmental entity may appeal the action to a court of competent jurisdiction.5
(2) In such appeal, the person may seek and the court may grant any or all6
of the following forms of relief:7
(a) Injunctive or declaratory relief.8
(b) Judgment rendering the action void.9

Abstract: Requires the governing body of certain nongovernmental entities to cause a
transcript to be made of each meeting and for copies to be available in the manner
of the Public Records Law. Further specifies that any person aggrieved by action of
the nongovernmental entity or its governing body may seek relief in a court of
competent jurisdiction.
Proposed law specifies that it applies to each nongovernmental entity subject to the Open
Meetings Law, subject to audit by the legislative auditor pursuant to present law (R.S.
24:513), and whose employees are authorized to be members of a state or statewide
retirement system.
Proposed law requires the governing body of each such nongovernmental entity to cause a
transcript to be made of each meeting of the governing body or the nongovernmental entity.
Requires copies of each such transcript to be available upon request in the same manner as
copies of records of public bodies pursuant to the Public Records Law.
Proposed law further provides that any person aggrieved by any action taken by a
nongovernmental entity subject to the provisions of this Section or the governing body of

ask for injunctive or declaratory relief and/or a judgement rendering the action void.
