HLS 12RS-1706 ORIGINAL Page 1 of 3 Regular Session, 2012 HOUSE CONCURRENT RESOLUTI ON NO. 66 BY REPRESENTATIVE LEOPOLD COASTAL RES/COASTAL ZONE: Requests the Coastal Protection and Restoration Authority to include compensatory mitigation for fisheries impacts in the calculation of project costs for coastal restoration projects contained in the coastal master plan and annual plans A CONCURRENT RESOLUTI ON1 To urge and request the Coastal Protection and Restoration Authority to include in the2 calculation of project costs for coastal protection and restoration projects contained3 in the master plan for integrated coastal protection and the accompanying annual4 plans the costs of compensatory mitigation for negative impacts resulting from such5 projects to the state's fisheries.6 WHEREAS, the Coastal Protection and Restoration Authority (CPRA) is the state7 agency charged with the primary responsibility for protection and restoration of Louisiana's8 deteriorating coastline and coastal area; and9 WHEREAS, R.S. 49:214.5.3 requires that the Coastal Protection and Restoration10 Authority develop ". . . a master plan for integrated coastal protection and an annual plan for11 integrated coastal protection for protecting, conserving, enhancing, and restoring the coastal12 area through the construction and management of integrated coastal protection projects and13 programs, including privately funded marsh management projects or plans, and addressing14 those activities requiring a coastal use permit which significantly affect such projects, . . .";15 and16 WHEREAS, R.S. 49:214.5.3 also requires the CPRA to ". . . review, revise, and17 amend the master plan when necessary or, at a minimum, every five years."; and18 WHEREAS, R.S. 49:214.5.3 further requires that ". . . the master plan and the annual19 plan shall include requests for funding of projects and programs related to integrated coastal20 HLS 12RS-1706 ORIGINAL HCR NO. 66 Page 2 of 3 protection. The annual plan shall include at least a three-year projection of funding of1 projects and programs related to integrated coastal protection, including but not limited to2 relevant public or private funding sources."; and3 WHEREAS, the first review and revision of the master plan has been conducted by4 the CPRA throughout the past year with final adoption of the plan being presented for5 legislative approval during this 2012 Regular Session of the Legislature of Louisiana; and6 WHEREAS, although the estimated costs associated with various projects are7 included in the revised master plan for integrated coastal protection, those costs do not8 include any funds to be used as compensation for the displacement or negative impacts to9 the state's fisheries by the construction and implementation of the integrated coastal10 protection projects; and11 WHEREAS, fishing has been an integral part of the cultural and economic fabric of12 the Louisiana coast since even before it became a state, with a vast bounty of shrimp,13 oysters, crabs, and finfish available throughout the coastal area and a vast network of14 fishermen, processors, dealers, and, of course, restaurants that have kept Louisiana seafood15 available to our citizens and to people around the world; and16 WHEREAS, coastal protection and restoration activities have an obvious and17 dramatic impact on our coastal fisheries industries and an obvious and dramatic impact18 especially on the economic stability and viability of the industries, and impact that should19 not be ignored when developing a master plan for integrated coastal protection; and20 WHEREAS, the potentially negative impacts could be mitigated in various ways,21 including relocation of oyster reefs and leases, retraining of fishermen for other occupations,22 and recapitalization for affected fishermen but there can be no mitigation without monies23 available to fund such mitigation.24 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby25 urge and request the Coastal Protection and Restoration Authority to include in the26 calculation of project costs for coastal protection and restoration projects contained in the27 master plan for integrated coastal protection and the accompanying annual plans the costs28 of compensatory mitigation for negative impacts resulting from such projects to the state's29 fisheries.30 HLS 12RS-1706 ORIGINAL HCR NO. 66 Page 3 of 3 BE IT FURTHER RESOLVED that the Coastal Protection and Restoration Authority1 work with the Louisiana Oyster Task Force, the Louisiana Shrimp Task Force, and the2 Louisiana Crab Task Force to develop mitigation alternatives and programs to compensate3 for the potential negative impacts to the state's fisheries resulting from integrated coastal4 protection projects.5 BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the6 chairman of the Coastal Protection and Restoration Authority.7 DIGEST The digest printed below was prepared by House Legislative Services.
