AN ACT1
To amend and reenact R.S. 11:2031(5), relative to the Registrars of Voters Employees'2
Retirement System; to provide for final average compensation; to provide for3
transitional provisions; to provide an effective date; and to provide for related4
matters.5
Notice of intention to introduce this Act has been published.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 11:2031(5) is hereby amended and reenacted to read as follows:8

The following words and phrases, as used in this Chapter, unless a different10
meaning is plainly required by the context, shall have the following meaning11
meanings: 12

(5)(a) "Average compensation", for a member whose first employment14
making him eligible for membership in the system began on or before June 30, 2006,15
shall mean the average annual earned compensation of an employee for any period16
of thirty-six successive or joined months of service as an employee during which the17
said earned compensation was the highest. In case of interruption of employment, the18
thirty-six-month period shall be computed by joining employment periods19
immediately preceding and succeeding the interruption.20
(b) "Average compensation", for a member whose first employment making21
him eligible for membership in the system began on or after July 1, 2006, shall mean22
the average annual earned compensation of an employee for any period of sixty23
successive or joined months of service as an employee during which earned24
compensation was the highest. In case of interruption of employment, the sixty-25
month period shall be computed by joining employment periods immediately26
preceding and succeeding the interruption.27

Section 2. This Act shall be implemented according to the provisions of this Section.2
(A) For transitional purposes, the provisions of R.S. 11:2031(5), shall be3
phased in as follows:4
(1) For members retiring or entering the Deferred Retirement Option Plan5
before January 1, 2013, and whose first employment making them eligible for6
membership in the system began on or before June 30, 2006, the provisions of R.S.7
11:2031(5) shall apply as they existed before the effective date of this Act.8
(2) For those members retiring or entering the Deferred Retirement Option9
Plan on or after January 1, 2013, and on or before December 31, 2014, and whose10
first employment making them eligible for membership in the system began on or11
before June 30, 2006, the period used to calculate monthly average final12
compensation shall be thirty-six months plus the number of whole months since13
January 1, 2013.14
(B) Notwithstanding any other provision of this Section to the contrary, the15
monthly average final compensation expressed in dollars used to compute a16
member's benefit after the effective date of this Act shall not be less than the dollar17
amount of the average monthly earnings during the member's highest thirty-six18
consecutive months or joined months of service earned for employment before19
January 1, 2013.20
Section 3. This Act shall become effective on July 1, 2012; if vetoed by the governor21
and subsequently approved by the legislature, this Act shall become effective on July 1,22
2012, or on the day following such approval by the legislature, whichever is later.23
