AN ACT1
To amend and reenact R.S. 38:2225.2.1(A)(1) and (3), relative to public contracts; to extend2
the time relative to the utilization of design-build contracts under certain3
circumstances; to provide applicability; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 38:2225.2.1(A)(1) and (3) are hereby amended and reenacted to read6
as follows: 7
ยง2225.2.1. Design-build contracts; authorized use by certain public entities in areas8
damaged by Hurricane Katrina, Hurricane Rita, or both9
A.(1) Notwithstanding any law to the contrary, the following public entities10
may utilize use the design-build method in the construction or repair of any public11
building or structure which has been destroyed or damaged by Hurricane Katrina,12
Hurricane Rita, or both, or any public building or structure to be constructed or13
repaired to meet a homeland security or criminal justice need pursuant to a hurricane14
recovery plan:  the division of administration, the Recovery School District, 	the15
Orleans Parish School Board, the city of New Orleans, sheriffs, housing16
authorities, and parish governments in Calcasieu, Cameron, Jefferson, Orleans,17
Plaquemines, St. Bernard, St. Tammany, and Vermilion parishes and the Port of New18
Orleans.19

(3) For the purposes of this Section, "design-builder" means the entity21
contractually responsible for delivering the project design and construction.  This22
authority shall extend for five six years from July 10, 2007, after which time only23
those projects that were contracted for prior to that date may proceed. 24

Section 2. This Act shall become effective on July 1, 2012.
