(1/1/13) AN ACT1 To amend and reenact R.S. 45:844.8, relative to telephone communications; to provide2 relative to wireless telephonic solicitation, and to provide relative to rules and3 regulations; to provide for regulation of unrequested commercial text messages and4 third-party charges to the consumer for certain text message solicitations; and to5 provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 45:844.8 is hereby amended and reenacted to read as follows: 8 ยง844.8. Wireless telephonic solicitation; rules and regulations9 A. The Louisiana Public Service Commission shall promulgate such rules10 and regulations which comply with federal regulations that prohibit a telemarketer11 from making wireless telephonic solicitations.12 B. The Louisiana Public Service Commission shall further promulgate13 such rules and regulations regarding unrequested commercial text messages14 and third-party charges to the consumer for certain text message solicitations.15 Section 2. Public Service Commission shall promulgate rules and regulations which comply with federal regulations that prohibit a telemarketer from making wireless telephonic solicitations. Proposed law retains present law and adds that the commission shall promulgate rules and regulations regarding unrequested commercial text messages and third-party charges to the consumer for certain text message solicitations.
