TELECOMMUNICATIONS. Requires Louisiana Public Service Commission to promulgate
rules and regulations regarding unrequested commercial text messages and third-party
charges to the consumer for certain text message solicitations. (1/1/13)
AN ACT1
To amend and reenact R.S. 45:844.8, relative to telephone communications; to provide2
relative to wireless telephonic solicitation, and to provide relative to rules and3
regulations; to provide for regulation of unrequested commercial text messages and4
third-party charges to the consumer for certain text message solicitations; and to5
provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 45:844.8 is hereby amended and reenacted to read as follows: 8
ยง844.8.  Wireless telephonic solicitation; rules and regulations9
A. The Louisiana Public Service Commission shall promulgate such rules10
and regulations which comply with federal regulations that prohibit a telemarketer11
from making wireless telephonic solicitations.12
B. The Louisiana Public Service Commission shall further promulgate13
such rules and regulations regarding unrequested commercial text messages14
and third-party charges to the consumer for certain text message solicitations.15
Section 2. This Act shall become effective on January 1, 2013.16 SB NO. 210

DIGEST
Present law provides that the La. Public Service Commission shall promulgate rules and
regulations which comply with federal regulations that prohibit a telemarketer from making
wireless telephonic solicitations.
Proposed law retains present law and adds that the commission shall promulgate rules and
regulations regarding unrequested commercial text messages and third-party charges to the
consumer for certain text message solicitations.
Effective January 1, 2013.
