BY SENATORS MORRISH AND THOMPSON 
AN ACT1
To enact R.S. 30:2054(B)(2)(b)(x), relative to air quality control; to provide for exceptions2
to the powers of the secretary of the Department of Environmental Quality; to allow3
sweet potato farmers to burn their crates used to store or transport sweet potatoes;4
to provide terms and conditions; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 30:2054(B)(2)(b)(x) is hereby enacted to read as follows: 7
ยง2054. Air quality control; secretary of environmental quality; powers and duties8

B. The secretary shall have the following powers and duties:10

(2)(a) *          *          *12
(b) Nothing in this law shall be deemed to grant to the secretary any13
jurisdiction or authority to make any rule, regulation, recommendations, or14
determination with respect to any of the following:15

(x) Controlled burning, after written notice to the local fire department17
and sheriff's office, of agriculture materials, including crates, used in connection18
with the storage or transportation of sweet potatoes.19
