Regular Session, 2012 SENATE BILL NO. 278 BY SENATOR KOSTELKA COURTS. Exempts the office of workers' compensation from paying certain court costs and fees. (8/1/12) AN ACT1 To enact R.S. 23:1174.2, relative to payment of certain costs of court; to exempt the office2 of workers' compensation from the payment of certain costs of court; and to provide3 for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 23:1174.2 is hereby enacted to read as follows: 6 ยง1174.2. Costs of proceedings and other fees not required from the office of7 workers' compensation8 The office of workers' compensation or its director shall not be required9 to furnish any court bond, nor to make a deposit for or pay any costs of court10 in any legal proceedings, nor to pay any costs or fees in connection with the11 recordation in the mortgage records of any parish of a sworn statement showing12 the amount of contribution, interest, and penalties in default by an employer.13 No clerk of any court, sheriff, recorder of mortgages or any other public official14 shall fail or refuse to perform any service in connection with proceedings15 brought by the office of workers' compensation or its director on the ground16 that costs have not been advanced or guaranteed, nor shall they be entitled to17 SB NO. 278 SLS 12RS-620 ORIGINAL Page 2 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. charge for any certified copies of any document which they shall be required to1 furnish on request of the office of workers' compensation or its director. 2 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Cathy R. Wells DIGEST Proposed law prohibits any clerk of any court, sheriff, recorder of mortgages or any other public official from assessing and collecting any costs, bonds, deposits, or fees in connection with the recordation in the mortgage records of any parish of a sworn statement showing the amount of contribution, interest, and penalties in default by an employer from the office of workers' compensation or its director. Proposed law further prohibits any clerk of any court, sheriff, recorder of mortgages or any other public official from refusing to perform any service in connection with proceedings brought by the office of workers' compensation or its director on the ground that costs have not been advanced or guaranteed. Proposed law also prohibits costs to be assessed for any certified copies of any document which is required to be furnished on request of the office of workers' compensation or its director.
