(7/1/12) AN ACT1 To enact Subpart R of Part II-A of Chapter 1 of Subtitle I of Title 39 of the Louisiana2 Revised Statutes of 1950, to be comprised of R.S. 39:100.126, relative to special3 funds; to establish the Prescription Drug Overdose and Abuse Awareness Fund; to4 provide for the deposit of certain monies into the fund; to provide for the uses of5 monies in the fund; to provide for an effective date; and to provide for related6 matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. Subpart R of Part II-A of Chapter 1 of Subtitle I of Title 39 of the9 Louisiana Revised Statutes of 1950, to be comprised of R.S. 39:100.126, is hereby enacted10 to read as follows:11 SUBPART R. PRESCRIPTION DRUG OVERDOSE AND ABUSE12 AWARENESS FUND13 ยง100.126. Prescription Drug Overdose and Abuse Awareness Fund14 A. B. The source of monies deposited into the fund shall be any monies1 appropriated annually by the legislature including donations, gifts, grants, or2 any other monies which may be provided by law. Monies credited to the fund3 shall be used exclusively as provided in Subsection C of this Section.4 C. Subject to an annual appropriation by the legislature, monies in the5 fund shall be used solely to:6 (1) Design and implement social marketing campaigns to create7 awareness about prescription opioid misuse, abuse, and overdose.8 (2) Develop and support programs of awareness and outreach designed9 to change public perception and influence behavior about prescription opioid10 misuse, abuse, and overdose.11 (3) Develop and implement educational programs to increase awareness,12 knowledge, and resources related to the risks of prescription opioid misuse,13 abuse, and overdose.14 (4) Design and implement social marketing campaigns to facilitate the15 proper disposal of leftover or unused prescription medications.16 D. All unexpended and unencumbered monies in the fund at the end of17 the fiscal year shall remain in the fund. The monies in the fund shall be invested18 by the state treasurer in the same manner as monies in the state general fund,19 and interest earned on the investment of these monies shall be credited to the20 state general fund.21 Section 2. This Act shall become effective on July 1, 2012; if vetoed by the governor22 and subsequently approved by the legislature, this Act shall become effective on July 1,23 2012, or on the day following such approval by the legislature, whichever is later.24 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Jay R.
