Regular Session, 2012 SENATE BILL NO. 359 BY SENATOR MORRISH AUTOMOBILE INSURANCE. Provides for selection or rejection of uninsured motorist coverage pursuant to the Louisiana Uniform Electronic Transactions Act. (8/1/12) AN ACT1 To enact R.S. 22:1295(1)(a)(v), relative to uninsured motorist coverage; to provide for2 selection or rejection of uninsured motorist coverage pursuant to the Louisiana3 Uniform Electronic Transactions Act; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 22:1295(1)(a)(v) is hereby enacted to read as follows: 6 ยง1295. DIGEST Morrish (SB 359) Present law provides that the rejection, selection of lower limits, or selection of economic- only uninsured motorist coverage shall be made only on a form prescribed by the commissioner of insurance. Requires the prescribed form to be provided by the insurer and signed by the named insured or his legal representative. Proposed law retains present law and allows for the prescribed form to be provided by the insurer and signed by the named insured or his legal representative in accordance with the Louisiana Uniform Electronic Transactions Act. Proposed law requires the commissioner to adopt reasonable rules and regulations as are necessary and proper to carry out the purposes of proposed law pursuant to the Administrative Procedure Act. Effective August 1, 2012. (Adds R.S. 22:1295(1)(a)(v) and (7)) Summary of Amendments Adopted by Senate Committee Amendments Proposed by Senate Committee on Insurance to the original bill. 1. Makes technical changes. 2. Requires the commissioner to adopt reasonable rules and regulations to carry out the purposes of proposed law pursuant to the Administrative Procedure Act.
