ENVIRONMENT QUALITY DEPT. Provides that the secretary of the Department of
Environmental Quality shall recover the costs of an expedited permitting program. (8/1/12)
AN ACT1
To amend and reenact R.S. 30:2014.5, relative to environmental quality; to require the2
secretary of the Department of Environmental Quality to recover all additional costs3
associated with processing an expedited permit; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 30:2014.5 is hereby amended and reenacted to read as follows: 6
ยง2014.5. Expedited permitting program7
The secretary is authorized to develop and implement a program to expedite8
the processing of permits, modifications, licenses, registrations, or variances for9
environmental permit applicants who may request such services and the secretary10
shall adopt rules in accordance with the Administrative Procedure Act which shall11
include a notice that indicates such permit is an expedited permit.  The secretary12
shall recover from the applicant all additional costs associated with processing13
an expedited application.  The costs recovered shall include every overtime hour14
or portion thereof that a department employee or contractor works processing15
the expedited application but shall not exceed the maximum per hour overtime16
salary, including associated related benefits of a civil service employee of the17 SB NO. 451

Present law provides that the secretary of DEQ may develop and implement a program to
expedite the processing of permits, modifications, licenses, registrations, or variances for
environmental permit applicants.
Proposed law requires that the secretary shall recover all additional costs associated with
processing an expedited application.
Proposed law provides that the costs recovered shall include every overtime hour, or portion
of, that a department employee or contractor works processing the expedited application, not
to exceed the maximum per hour overtime salary, including associated related benefits, of
a civil service employee of the department.
Effective August 1, 2012.
