SENATE BILL NO. 452

CRIMINAL RECORDS.  Provides that members of the press have access to booking
photographs.  (8/1/12)
AN ACT1
To enact R.S. 44:3(A)(4)(b)(viii), relative to public records; to provide with respect to2
records of prosecutive, investigative, and law enforcement agencies, and3
communications districts; to provide relative to the initial report; to provide that the4
booking photograph of any person arrested for an alleged offense shall be subject to5
disclosure; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 44:3(A)(4)(b)(viii) is hereby enacted to read as follows: 8
ยง3. Records of prosecutive, investigative, and law enforcement agencies, and9
communications districts10
A. Nothing in this Chapter shall be construed to require disclosures of11
records, or the information contained therein, held by the offices of the attorney12
general, district attorneys, sheriffs, police departments, Department of Public Safety13
and Corrections, marshals, investigators, public health investigators, correctional14
agencies, communications districts, intelligence agencies, or publicly owned water15
districts of the state, which records are:16

(b) The initial report shall set forth:2

(viii) If requested pursuant to R.S. 44:1 the booking photograph of any4
person arrested for an alleged offense.5

Present law provides that certain records or information contained therein which are held by
law enforcement agencies and communication districts will not be subject to disclosure.
Proposed law provides that if requested pursuant to present law the booking photograph of
any person arrested for an alleged offense will be disclosed.
Effective August 1, 2012.
