MINERALS.  Provides relative to the mineral lease and notice of breach.  (8/1/12)
AN ACT1
To enact R.S. 31:136.1, relative to mineral leases; to provide relative to notice and2
opportunity to comply with lease conditions to restore property; to provide terms,3
conditions, and requirements; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 31:136.1 is hereby enacted to read as follows: 6
ยง136.1. Written notice; requirement and effect on claims for surface or7
subsurface damages or dissolution of lease8
In an action for restoration of the surface or damages for surface or9
subsurface damages alleged to have occurred from surface mineral activity, the10
lessor or surface owner of land subject to a mineral lease shall give mineral11
lessees written notice of the asserted breach to perform or alleged damage to the12
property and allow a reasonable time for performance by the lessees as a13
prerequisite to a judicial demand for damages or dissolution of the lease.14 SB NO. 480

Proposed law provides that in an action for restoration of the surface or subsurface damages
alleged to have occurred from surface mineral activity, the lessor or surface owner of the
land is required to give mineral lessees written notice of the asserted breach to perform
alleged damage to the property and allow a reasonable time for performance by the lessees
as a prerequisite to a judicial demand for damages or dissolution of the lease.
Effective August 1, 2012.
